  1.1                          A bill for an act 
  1.2             relating to human services; providing program options 
  1.3             for certain persons with developmental disabilities; 
  1.4             appropriating money. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [PROGRAM OPTIONS FOR CERTAIN PERSONS WITH 
  1.7   DEVELOPMENTAL DISABILITIES.] 
  1.8      (a) The commissioner of human services shall ensure that 
  1.9   services continue to be available to persons with developmental 
  1.10  disabilities who were covered by social services supplemental 
  1.11  grants prior to July 1, 2001.  Services shall be provided in 
  1.12  priority order as follows: 
  1.13     (1) to the extent possible, the commissioner shall 
  1.14  establish for these persons targeted slots under the home and 
  1.15  community-based waivered services program for persons with 
  1.16  mental retardation or related conditions; 
  1.17     (2) those persons who cannot be accommodated under clause 
  1.18  (1) shall, to the extent possible, be provided services through 
  1.19  other home and community-based waivered services programs; 
  1.20     (3) notwithstanding Minnesota Statutes, section 256I.04, 
  1.21  subdivision 2a, those persons who cannot be served by a waiver 
  1.22  program under clause (1) or (2) shall be eligible for services 
  1.23  under Minnesota Statutes, chapter 256I; and 
  1.24     (4) any remaining persons shall continue to receive 
  1.25  services through community social services supplemental grants 
  2.1   to the affected counties. 
  2.2      (b) This section applies only to individuals receiving 
  2.3   services under social services supplemental grants as of June 
  2.4   30, 2001. 
  2.5      Sec. 2.  [APPROPRIATION.] 
  2.6      $....... is appropriated from the general fund to the 
  2.7   commissioner of human services for the biennium beginning July 
  2.8   1, 2001, for the purposes of section 1.
