  1.1                          A bill for an act 
  1.2             relating to civil actions; awarding costs to 
  1.3             prevailing party in summary judgment actions; 
  1.4             proposing coding for new law in Minnesota Statutes, 
  1.5             chapter 549. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [549.025] [SUMMARY JUDGMENT; COSTS AWARDED TO 
  1.8   PREVAILING PARTY.] 
  1.9      The court shall award the prevailing party on a motion for 
  1.10  summary judgment that party's reasonable costs and disbursements 
  1.11  paid or incurred, including reasonable attorney fees and fees 
  1.12  and mileage paid for service of process by the sheriff or by a 
  1.13  private person.  The party required to pay reasonable attorney 
  1.14  fees under this section is not required to pay more than the 
  1.15  cost or value of its own legal services in the action. 
  1.16     This section supersedes any inconsistent provision of law.
