  1.1                          A bill for an act 
  1.2             relating to education; providing for an educational 
  1.3             accountability council; conferring powers and duties 
  1.4             including rulemaking authority; proposing coding for 
  1.5             new law in Minnesota Statutes, chapter 127A. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [127A.605] [EDUCATIONAL ACCOUNTABILITY 
  1.8   COUNCIL.] 
  1.9      Subdivision 1.  [CREATION; APPOINTMENT.] (a) The 
  1.10  educational accountability council consists of nine members 
  1.11  appointed as follows: 
  1.12     (1) three members appointed by the governor with the advice 
  1.13  and consent of the senate; 
  1.14     (2) three members appointed by the house, two of whom the 
  1.15  speaker shall appoint and one of whom the house minority leader 
  1.16  shall appoint; and 
  1.17     (3) three members appointed by the senate, two of whom the 
  1.18  committee on committees shall appoint and one of whom the senate 
  1.19  minority leader shall appoint. 
  1.20     (b) The commissioner shall serve as an ex officio member of 
  1.21  the council and as council chair. 
  1.22     (c) Membership terms, compensation, removal of members, and 
  1.23  filling of vacancies are governed by section 15.0575. 
  1.24     Subd. 2.  [DUTIES.] (a) The council shall advise the 
  1.25  commissioner and the legislature on matters affecting state 
  2.1   education policy and related short- and long-term education 
  2.2   planning. 
  2.3      (b) The council may adopt new rules and amend them or may 
  2.4   amend any existing rules only under specific authority.  The 
  2.5   council may make technical changes or corrections to adopted 
  2.6   rules without specific authority. 
  2.7      (c) Upon the request of an affected person or entity, the 
  2.8   council may review the decisions of the commissioner under 
  2.9   sections 127A.41 and 127A.42 and issue a council decision.  A 
  2.10  council decision may be appealed to the Minnesota court of 
  2.11  appeals. 
  2.12     (d) The council shall assume the duties of the state board 
  2.13  of education affecting charter schools under section 124D.10. 
  2.14     Sec. 2.  [REVISOR INSTRUCTION.] 
  2.15     Notwithstanding other law to the contrary, in the next and 
  2.16  subsequent editions of Minnesota Statutes and Minnesota Rules, 
  2.17  all references to the state board of education shall be changed 
  2.18  to the educational accountability council, and all references to 
  2.19  the commissioner under Minnesota Statutes, section 124D.896, 
  2.20  shall be changed to the educational accountability council, 
  2.21  consistent with section 1.  The changes made by the revisor 
  2.22  shall be effective December 31, 1999. 
  2.23     Sec. 3.  [EFFECTIVE DATE.] 
  2.24     Sections 1 and 2 are effective the day following final 
  2.25  enactment.
