  1.1                          A bill for an act 
  1.2             relating to lawful gambling; specifying locations 
  1.3             where pull-tab dispensing machines may be used; 
  1.4             requiring certain information to be printed on raffle 
  1.5             tickets; authorizing certain tipboard games and 
  1.6             tipboard rules; increasing maximum consolation prizes 
  1.7             for bingo games; specifying maximum tipboard prizes; 
  1.8             amending Minnesota Statutes 1998, sections 349.151, 
  1.9             subdivision 4b, and by adding a subdivision; 349.1711, 
  1.10            by adding a subdivision; and 349.211, subdivision 2, 
  1.11            and by adding a subdivision. 
  1.12  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.13     Section 1.  Minnesota Statutes 1998, section 349.151, 
  1.14  subdivision 4b, is amended to read: 
  1.15     Subd. 4b.  [PULL-TAB SALES FROM DISPENSING DEVICES.] (a) 
  1.16  The board may by rule authorize but not require the use of 
  1.17  pull-tab dispensing devices. 
  1.18     (b) Rules adopted under paragraph (a): 
  1.19     (1) must limit the number of pull-tab dispensing devices on 
  1.20  any permitted premises to three; 
  1.21     (2) must limit the use of pull-tab dispensing devices to a 
  1.22  permitted premises which is (i) a licensed premises for on-sales 
  1.23  of intoxicating liquor or 3.2 percent malt beverages or (ii) a 
  1.24  licensed bingo hall that allows gambling only by persons 18 
  1.25  years or older; and 
  1.26     (3) must prohibit the use of pull-tab dispensing devices at 
  1.27  any licensed premises where pull-tabs are sold other than 
  1.28  through a pull-tab dispensing device by an employee of the 
  2.1   organization who is also the lessor or an employee of the lessor.
  2.2      (c) Notwithstanding rules adopted under paragraph (b), 
  2.3   pull-tab dispensing devices may be used in establishments 
  2.4   licensed for the off-sale of intoxicating liquor, other than 
  2.5   drugstores and general food stores licensed under section 
  2.6   340A.405, subdivision 1. 
  2.7      (d) The director may charge a manufacturer a fee of up to 
  2.8   $5,000 per pull-tab dispensing device to cover the costs of 
  2.9   services provided by an independent testing laboratory to 
  2.10  perform testing and analysis of pull-tab dispensing devices.  
  2.11  The director shall deposit in a separate account in the state 
  2.12  treasury all money the director receives as reimbursement for 
  2.13  the costs of services provided by independent testing 
  2.14  laboratories that have entered into contracts with the state to 
  2.15  perform testing and analysis of pull-tab dispensing devices.  
  2.16  Money in the account is appropriated to the director to pay the 
  2.17  costs of services under those contracts. 
  2.18     Sec. 2.  Minnesota Statutes 1998, section 349.151, is 
  2.19  amended by adding a subdivision to read: 
  2.20     Subd. 4c.  [RAFFLE TICKETS.] A raffle ticket must at a 
  2.21  minimum list the three most expensive prizes in the raffle.  If 
  2.22  additional prizes will be awarded that are not contained on the 
  2.23  raffle ticket, the raffle ticket must contain the statement, "a 
  2.24  complete list of additional prizes is available upon request." 
  2.25     Sec. 3.  Minnesota Statutes 1998, section 349.1711, is 
  2.26  amended by adding a subdivision to read: 
  2.27     Subd. 4.  [TIPBOARD RULES.] The board may by rule permit 
  2.28  tipboard games with multiple seals.  The board may adopt rules 
  2.29  for cumulative or carryover tipboard prizes. 
  2.30     Sec. 4.  Minnesota Statutes 1998, section 349.211, 
  2.31  subdivision 2, is amended to read: 
  2.32     Subd. 2.  [PROGRESSIVE BINGO GAMES.] A prize of up to 
  2.33  $2,000 may be awarded for a progressive bingo game, including a 
  2.34  cover-all game.  The prize for a progressive bingo game may 
  2.35  start at $300 and be increased by up to $100 for each occasion 
  2.36  during which the progressive bingo game is played.  A 
  3.1   consolation prize of up to $100 $200 for a progressive bingo 
  3.2   game may be awarded in each occasion during which the 
  3.3   progressive bingo game is played and the accumulated prize is 
  3.4   not won.  The total amount awarded in progressive bingo game 
  3.5   prizes in any calendar year may not exceed $36,000. 
  3.6      Sec. 5.  Minnesota Statutes 1998, section 349.211, is 
  3.7   amended by adding a subdivision to read: 
  3.8      Subd. 2c.  [TIPBOARD PRIZES.] The maximum prize which may 
  3.9   be awarded for a tipboard ticket is $500, not including any 
  3.10  cumulative or carryover prizes.  Cumulative or carryover prizes 
  3.11  in a tipboard game may not exceed $2,500. 
  3.12     Sec. 6.  [EFFECTIVE DATE.] 
  3.13     Sections 1, 2, 3, and 4 are effective the day following 
  3.14  final enactment.  Section 5 is effective the day following the 
  3.15  effective date of the rules adopted under section 3.
