  1.1                          A bill for an act 
  1.2             relating to fire safety; requiring the state fire 
  1.3             marshal to adopt rules for fire retardant standards 
  1.4             for cigarettes; proposing coding for new law in 
  1.5             Minnesota Statutes, chapter 299F. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [299F.90] [CIGARETTE FIRE SAFETY.] 
  1.8      Subdivision 1.  [STANDARDS.] (a) Cigarettes sold, offered 
  1.9   for sale, or manufactured in this state must comply with 
  1.10  fire-retardant cigarette standards based on rules adopted by the 
  1.11  commissioner of public safety, with the assistance of the state 
  1.12  fire marshal.  The rules must be adopted before July 1, 2003.  
  1.13  The standards must: 
  1.14     (1) ensure that cigarettes meet a fire-retardant cigarette 
  1.15  performance standard that limits the risk that a cigarette will 
  1.16  ignite upholstered furniture, mattresses, or other household 
  1.17  furnishings; and 
  1.18     (2) ensure that cigarettes, if ignited, will stop burning 
  1.19  within a time period specified by the standard if the cigarettes 
  1.20  are not smoked during that period. 
  1.21     (b) A person engaged in the manufacture of cigarettes shall 
  1.22  submit to the state fire marshal, in writing and before any sale 
  1.23  in this state, certification that the manufacturer's products 
  1.24  meet the standards required under paragraph (a). 
  1.25     Subd. 2.  [CONDITIONAL REPEALER.] If federal fire-retardant 
  2.1   cigarette standards are enacted that preempt this section, this 
  2.2   section is repealed on the day those federal standards take 
  2.3   effect. 
  2.4      Sec. 2.  [EFFECTIVE DATE.] 
  2.5      Section 1 is effective the day following final enactment.
