A bill for an act
relating to energy; requiring reports by certain residential heating, delivered-fuel
suppliers; proposing coding for new law in Minnesota Statutes, chapter 216B.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

HEATING FUEL.

new text begin (a) A fuel oil or propane company receiving $50,000 or more from the Low Income
Home Energy Assistance Program (LIHEAP) for the previous heating season for deliveries
to customers in the state must report the following information to the Office of Energy
Security by August 1, next following the heating season on a form prepared by the office:

new text begin (1) its total number of customers;
new text end

new text begin (2) its total number of customers receiving LIHEAP assistance; and
new text end

new text begin (3) all of the following separately for its residential and residential LIHEAP
customers:
new text end

new text begin (i) the number of customers refused delivery at any time during the heating season.
Vendors must report if they refused delivery to the same service address more than one
time during the heating season;

new text begin (ii) the number of customers on keep-fill;
new text end

new text begin (iii) the number of full and partial pre-buy customers;
new text end

new text begin (iv) the number of customers currently on budget-billing or payment plans;
new text end

new text begin (v) the number of customers currently behind on their bills;
new text end

new text begin (vi) the amount of LIHEAP funding received for the previous heating season;
new text end

new text begin (vii) the per gallon price for fuel for each of the heating season months;
new text end

new text begin (viii) all non-fuel-related fees paid by LIHEAP funds; and
new text end

new text begin (ix) a price list of routine services that are normal and customary, including, but
not limited to:

new text begin (A) leak or pressure test fee;
new text end

new text begin (B) minimum delivery amounts and fees;
new text end

new text begin (C) special trip during business hours and nonbusiness hours;
new text end

new text begin (D) same-day delivery fee;
new text end

new text begin (E) after hours, weekend, and holiday delivery fee; and
new text end

new text begin (F) next work day delivery fee.

new text begin The Office of Energy Security must regularly track delivered heating fuel prices
throughout the year.

new text begin (b) For the purpose of this section, "heating season" means the period from October
15 to the next April 15.
