A bill for an act
 relating to motor carriers; modifying definition of private carrier; amending
Minnesota Statutes 2006, section 221.011, subdivision 26.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 221.011, subdivision 26, is amended to
read:


Subd. 26.

Private carrier.

new text begin (a) new text end "Private carrier" means a person engaged in the
transportation of property or passengers by motor vehicle when:

(1) the person transporting the property or passengers is engaged in a business other
than transportationdeleted text begin ;deleted text end and

deleted text begin (2)deleted text end the transportation is within the scope of and furthers a primary business, other
than transportation, of that persondeleted text begin .deleted text end new text begin ; or

new text begin (2) the person transporting the property or passengers by motor vehicle is a charitable
organization exempt from taxation under section 501(c)(3) of the Internal Revenue Code
and the transportation furthers the charitable organization's charitable mission.

described in section 221.025.
