A bill for an act
relating to local government; authorizing zoning for owner-occupied residential
uses; amending Minnesota Statutes 2008, section 462.357, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 462.357, is amended by adding a
subdivision to read:

new text begin Owner-occupied use may be required. new text end

new text begin In order to stabilize and
strengthen municipalities and neighborhoods by increasing the percentage of residential
properties that are owner-occupied, a municipality may adopt an ordinance providing
for owner-occupied residential use. The ordinance must define "owner-occupied." An
owner-occupied residential use ordinance may only be applied to residential property at
the time it is first sold after completion of a foreclosure or forfeiture process.
