  1.1                          A bill for an act 
  1.2             relating to education; amending definition of district 
  1.3             for homeless students; clarifying date for homeless 
  1.4             student count; providing for grants for education 
  1.5             programs serving homeless students; appropriating 
  1.6             money; amending Minnesota Statutes 1998, sections 
  1.7             124D.70; and 127A.47, subdivision 2; Laws 1997, First 
  1.8             Special Session chapter 4, article 2, section 48. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1998, section 124D.70, is 
  1.11  amended to read: 
  1.12     124D.70 [ADDITIONAL REVENUE FOR HOMELESS STUDENTS.] 
  1.13     In addition to revenue received under sections 124D.68, 
  1.14  subdivisions 8 and 9, and 124D.69, subdivision 1, a district 
  1.15  shall receive additional revenue for homeless pupils who are 
  1.16  eligible to participate in the graduation incentives program 
  1.17  according to section 124D.68, subdivision 1, paragraph (a), 
  1.18  clause (9), equal to $100 per pupil unit.  The additional 
  1.19  revenue received must be based on the district's number of 
  1.20  homeless students enrolled on October 1.  The revenue received 
  1.21  under this section shall be used for expanding education 
  1.22  services to include preschool, after-school, or summer school 
  1.23  programs to provide transition and follow-up services to 
  1.24  homeless pupils who are placed or mainstreamed in a district 
  1.25  school, or to provide parent education and support services.  
  1.26  The additional revenue shall be paid to the public or nonprofit 
  1.27  school program providing services to homeless pupils.  A student 
  2.1   shall not be considered homeless under this section if the 
  2.2   student was displaced from home as a result of a natural 
  2.3   disaster. 
  2.4      Sec. 2.  Minnesota Statutes 1998, section 127A.47, 
  2.5   subdivision 2, is amended to read: 
  2.6      Subd. 2.  [REPORTING; REVENUE FOR HOMELESS.] For all school 
  2.7   purposes, unless otherwise specifically provided by law, a 
  2.8   homeless pupil is a resident of the school district in which the 
  2.9   homeless shelter or other program, center, or facility assisting 
  2.10  the homeless pupil or the pupil's family is located that enrolls 
  2.11  the pupil. 
  2.12     Sec. 3.  Laws 1997, First Special Session chapter 4, 
  2.13  article 2, section 48, is amended to read: 
  2.14     Sec. 48.  [MATCHING GRANTS FOR EDUCATION PROGRAMS SERVING 
  2.15  HOMELESS CHILDREN.] 
  2.16     A school district or a nonprofit entity contracting with a 
  2.17  school district to provide education and transition services for 
  2.18  homeless children is eligible for a matching grant for capital 
  2.19  facilities which serve homeless children and their families.  
  2.20  Grant proceeds may be used to design, furnish, equip, acquire, 
  2.21  repair, or construct a facility for providing education and 
  2.22  transition services for homeless pupils.  To obtain a grant, a 
  2.23  school district or nonprofit entity must submit an application 
  2.24  to the commissioner of children, families, and learning in the 
  2.25  form and manner the commissioner establishes.  Grants must be 
  2.26  matched by $1 of nonstate money for every $1 $2 of grant money 
  2.27  received.  The commissioner shall take into consideration the 
  2.28  number of concentration of homeless children served by a school 
  2.29  district when awarding grants.  The commissioner may award 
  2.30  matching grants of up to $500,000 per school district. 
  2.31     Sec. 4.  [GRANT FOR IMPLEMENTING GRADUATION STANDARDS IN 
  2.32  ALTERNATIVE PROGRAMS AND AREA LEARNING CENTERS.] 
  2.33     Subdivision 1.  [ESTABLISHMENT.] A grant program is 
  2.34  established for alternative programs and area learning centers 
  2.35  to implement the graduation standards adopted by the state board 
  2.36  of education. 
  3.1      Subd. 2.  [SYSTEM OF IMPLEMENTATION.] The Minnesota 
  3.2   association of alternative programs must develop a system to 
  3.3   implement the graduation standards for learners in alternative 
  3.4   programs, including area learning centers, contract 
  3.5   alternatives, correctional institutions, and homeless shelters. 
  3.6      The system must include: 
  3.7      (1) preassessment and documentation of student performance; 
  3.8      (2) adaptation, modification, and validation of graduation 
  3.9   standards performance packages; 
  3.10     (3) implementation of a process to promote continuous 
  3.11  improvement in a standards-driven system; and 
  3.12     (4) integration of school-to-work activities into the 
  3.13  graduation standards. 
  3.14     Subd. 3.  [GRANT AWARDS.] The commissioner shall award up 
  3.15  to 20 grants in an amount not to exceed $20,000 each.  Grant 
  3.16  recipients must be alternative programs, including area learning 
  3.17  centers, contract alternatives, correctional institutions, and 
  3.18  homeless shelters.  Grant recipients must implement, disseminate 
  3.19  information, and provide regional training for the system 
  3.20  established under subdivision 2.  Grant recipients must report 
  3.21  their progress to the Minnesota association of alternative 
  3.22  programs at the association's request. 
  3.23     Sec. 5.  [APPROPRIATION.] 
  3.24     Subdivision 1.  [DEPARTMENT OF CHILDREN, FAMILIES, AND 
  3.25  LEARNING.] The following sums are appropriated from the general 
  3.26  fund to the department of children, families, and learning in 
  3.27  the fiscal years indicated. 
  3.28     Subd. 2.  [MATCHING GRANTS FOR EDUCATION PROGRAMS SERVING 
  3.29  HOMELESS CHILDREN.] For matching grants for education programs 
  3.30  serving homeless children: 
  3.31       $1,100,000     .....     2000
  3.32     This appropriation is available until June 30, 2001. 
  3.33     Subd. 3.  [GRADUATION IMPLEMENTATION GRANTS.] For a grant 
  3.34  to implement the graduation standards in alternative programs 
  3.35  and alternative learning centers: 
  3.36       $  500,000     .....     2000 
  4.1      Of this amount, $200,000 is for the Minnesota association 
  4.2   of alternative programs to develop a system of implementation of 
  4.3   the graduation standards for learners in alternative programs.
