1.1 A bill for an act 1.2 relating to crime; adding an exception to the crime of 1.3 female genital mutilation for certified nurse midwives 1.4 acting within the legal scope of their practice; 1.5 amending Minnesota Statutes 1996, section 609.2245, 1.6 subdivision 2. 1.7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8 Section 1. Minnesota Statutes 1996, section 609.2245, 1.9 subdivision 2, is amended to read: 1.10 Subd. 2. [PERMITTED ACTIVITIES.] A surgical procedure is 1.11 not a violation of subdivision 1 if the procedure: 1.12 (1) is necessary to the health of the person on whom it is 1.13 performed and is performed by: (i) a physician licensed under 1.14 chapter 147or; (ii) a physician in training under the 1.15 supervision of a licensed physician; or (iii) a certified nurse 1.16 midwife practicing within the nurse midwife's legal scope of 1.17 practice; or 1.18 (2) is performed on a person who is in labor or who has 1.19 just given birth and is performed for medical purposes connected 1.20 with that labor or birth: (i) by a physician licensed under 1.21 chapter 147or; (ii) a physician in training under the 1.22 supervision of a licensed physician; or (iii) a certified nurse 1.23 midwife practicing within the nurse midwife's legal scope of 1.24 practice. 1.25 Sec. 2. [EFFECTIVE DATE.] 1.26 Section 1 is effective August 1, 1997, and applies to 2.1 crimes committed on or after that date.
