A bill for an act
relating to natural resources; prohibiting expenditure of funds for Lake Ogechie
wild rice project until legal analysis is completed.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin LAKE OGECHIE WILD RICE RESTORATION PROJECT.

new text begin The commissioner of natural resources shall not expend funds for the Lake Ogechie
wild rice restoration project until the attorney general has:

new text begin (1) prepared and submitted to the governor and legislature a legal analysis and
opinion specifically addressing whether existing Minnesota Statutes, section 84.10,
conforms properly in all ways with both the constitutions of the United States and
Minnesota; and

new text begin (2) prepared and submitted to the governor and legislature a legal analysis and
opinion specifically addressing whether the Department of Natural Resources' working
document "Summary of the Effects of Minnesota Statutes, Section 84.09 and 84.10 on the
Harvesting of Wild Rice within the Original Boundaries of the Mille Lacs Reservation"
conforms properly in all ways with the constitutions and how it compares with the state's
legal position as expressed by both the offices of the governor and attorney general
concerning the continued existence of the original Mille Lacs Indian Reservation.
