  1.1                          A bill for an act 
  1.2             relating to municipal contracts; allowing awards of 
  1.3             contracts to certain bidders; amending Minnesota 
  1.4             Statutes 1994, section 471.345, by adding a 
  1.5             subdivision.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 471.345, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 15.  [SERVICE CONSIDERATION.] A municipality may 
  1.10  award a contract subject to this section to a bidder whose bid 
  1.11  is no more than five percent higher than the lowest bid if the 
  1.12  municipality determines that it will recover the difference 
  1.13  between the bids by economies in the cost of service for the 
  1.14  subject of the purchase during its lifetime.
