  1.1                          A bill for an act 
  1.2             relating to traffic regulations; allowing turn on red 
  1.3             arrow traffic signal, under certain conditions; 
  1.4             regulating speed limits in residential areas; 
  1.5             providing for disposition of proceeds of fines 
  1.6             collected for violation of work zone speed limits; 
  1.7             making technical changes; amending Minnesota Statutes 
  1.8             1994, sections 169.06, subdivision 5; and 169.14, 
  1.9             subdivisions 2 and 5d; repealing Minnesota Statutes 
  1.10            1994, section 169.01, subdivision 81. 
  1.11  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.12     Section 1.  Minnesota Statutes 1994, section 169.06, 
  1.13  subdivision 5, is amended to read: 
  1.14     Subd. 5.  [TRAFFIC-CONTROL SIGNALS.] Whenever traffic is 
  1.15  controlled by traffic-control signals exhibiting different 
  1.16  colored lights, or colored lighted arrows, successively one at a 
  1.17  time or in combination, only the colors Green, Red, and Yellow 
  1.18  shall be used, except for special pedestrian signals carrying a 
  1.19  word legend, and said lights shall indicate and apply to drivers 
  1.20  of vehicles and pedestrians as follows: 
  1.21     (a) Green indication: 
  1.22     (1) Vehicular traffic facing a circular green signal may 
  1.23  proceed straight through or turn right or left unless a sign at 
  1.24  such place prohibits either such turn.  But vehicular traffic, 
  1.25  including vehicles turning right or left, shall yield the 
  1.26  right-of-way to other vehicles and to pedestrians lawfully 
  1.27  within the intersection or adjacent crosswalk at the time such 
  1.28  signal is exhibited.  
  2.1      (2) Vehicular traffic facing a green arrow signal, shown 
  2.2   alone or in combination with another indication, may cautiously 
  2.3   enter the intersection only to make the movement indicated by 
  2.4   such arrow, or such other movement as is permitted by other 
  2.5   indications shown at the same time.  Such vehicular traffic 
  2.6   shall yield the right-of-way to pedestrians lawfully within an 
  2.7   adjacent crosswalk and to other traffic lawfully using the 
  2.8   intersection.  
  2.9      (3) Unless otherwise directed by a pedestrian-control 
  2.10  signal as provided in subdivision 6, pedestrians facing any 
  2.11  green signal, except when the sole green signal is a turn arrow, 
  2.12  may proceed across the roadway within any marked or unmarked 
  2.13  crosswalk.  
  2.14     (b) Steady yellow indication: 
  2.15     (1) Vehicular traffic facing a circular yellow signal is 
  2.16  thereby warned that the related green movement is being 
  2.17  terminated or that a red indication will be exhibited 
  2.18  immediately thereafter when vehicular traffic shall not enter 
  2.19  the intersection, except for the continued movement allowed by 
  2.20  any green arrow indication simultaneously exhibited.  
  2.21     (2) Pedestrians facing a circular yellow signal, unless 
  2.22  otherwise directed by a pedestrian control signal as provided in 
  2.23  subdivision 6, are thereby advised that there is insufficient 
  2.24  time to cross the roadway before a red indication is shown and 
  2.25  no pedestrian shall then start to cross the roadway.  
  2.26     (3) Vehicular traffic facing a steady yellow arrow signal 
  2.27  is thereby warned that the protected vehicular movement 
  2.28  permitted by the corresponding prior green arrow indication is 
  2.29  being terminated.  
  2.30     (c) Steady red indication: 
  2.31     (1) Vehicular traffic facing a circular red signal alone 
  2.32  shall stop at a clearly marked stop line, but if none, before 
  2.33  entering the crosswalk on the near side of the intersection, or 
  2.34  if none, then before entering the intersection and shall remain 
  2.35  standing until a green indication is shown, except as follows:  
  2.36  (i) the driver of a vehicle which is stopped as close as 
  3.1   practicable at the entrance to the crosswalk on the near side of 
  3.2   the intersection or, if none, then at the entrance to the 
  3.3   intersection in obedience to a red or stop signal, and with the 
  3.4   intention of making a right turn may make such the right turn, 
  3.5   after stopping, unless an official sign has been erected 
  3.6   prohibiting such that movement, but shall yield the right-of-way 
  3.7   to pedestrians and other traffic lawfully proceeding as directed 
  3.8   by the signal at said the intersection; or (ii) the driver of a 
  3.9   vehicle on a one-way street which that intersects another 
  3.10  one-way street on which traffic moves to the left shall stop in 
  3.11  obedience to a red or stop signal and may then make a left turn 
  3.12  into said the one-way street, unless an official sign has been 
  3.13  erected prohibiting the movement, but shall yield the 
  3.14  right-of-way to pedestrians and other traffic proceeding as 
  3.15  directed by the signal at said the intersection.  
  3.16     (2) Unless otherwise directed by a pedestrian-control 
  3.17  signal as provided in subdivision 6, pedestrians facing a steady 
  3.18  red signal alone shall not enter the roadway.  
  3.19     (3) Vehicular traffic facing a steady red arrow signal, 
  3.20  with the intention of making a movement indicated by the arrow, 
  3.21  shall stop at a clearly marked stop line, but if none, before 
  3.22  entering the crosswalk on the near side of the intersection, or 
  3.23  if none, then before entering the intersection and shall remain 
  3.24  standing until a permissive signal indication is displayed, 
  3.25  except as follows:  (i) the driver of a vehicle that is stopped 
  3.26  as close as practicable at the entrance to the crosswalk on the 
  3.27  near side of the intersection, or, if none, then at the entrance 
  3.28  to the intersection in obedience to a red or stop signal, and 
  3.29  with the intention of making a right turn may make the right 
  3.30  turn, after stopping, unless an official sign has been erected 
  3.31  prohibiting a right turn on a stop signal, but shall yield the 
  3.32  right-of-way to pedestrians and other traffic lawfully 
  3.33  proceeding as directed by the signal at the intersection; or 
  3.34  (ii) the driver of a vehicle on a one-way street that intersects 
  3.35  another one-way street on which traffic moves to the left shall 
  3.36  stop in obedience to a red or stop signal and may then make a 
  4.1   left turn into the one-way street, unless an official sign has 
  4.2   been erected prohibiting the movement, but shall yield the 
  4.3   right-of-way to pedestrians and other traffic proceeding as 
  4.4   directed by the signal at the intersection.  
  4.5      (d) In the event an official traffic-control signal is 
  4.6   erected and maintained at a place other than an intersection, 
  4.7   the provisions of this section are applicable except those which 
  4.8   can have no application.  Any stop required shall be made at a 
  4.9   sign or marking on the pavement indicating where the stop shall 
  4.10  be made, but in the absence of any such sign or marking the stop 
  4.11  shall be made at the signal. 
  4.12     (e) When a traffic-control signal indication or indications 
  4.13  placed to control a certain movement or lane are so identified 
  4.14  by placing a sign near the indication or indications, no other 
  4.15  traffic-control signal indication or indications within the 
  4.16  intersection shall control vehicular traffic for such movement 
  4.17  or lane. 
  4.18     Sec. 2.  Minnesota Statutes 1994, section 169.14, 
  4.19  subdivision 2, is amended to read: 
  4.20     Subd. 2.  [SPEED LIMITS.] (a) Where no special hazard 
  4.21  exists, the following speeds shall be lawful, but any speeds in 
  4.22  excess of such limits shall be prima facie evidence that the 
  4.23  speed is not reasonable or prudent and that it is unlawful; 
  4.24  except that the speed limit within any municipality shall be a 
  4.25  maximum limit and any speed in excess thereof shall be unlawful: 
  4.26     (1) 30 miles per hour in an urban district; 
  4.27     (2) 65 miles per hour in other locations during the 
  4.28  daytime; 
  4.29     (3) 55 miles per hour in such other locations during the 
  4.30  nighttime; and 
  4.31     (4) ten miles per hour in alleys; and 
  4.32     (5) 25 miles per hour in residential roadways if adopted by 
  4.33  the road authority having jurisdiction over the residential 
  4.34  roadway alleyways.  
  4.35     (b) A speed limit adopted under paragraph (a), clause (5), 
  4.36  is not effective unless the road authority has erected signs 
  5.1   designating the speed limit and indicating the beginning and end 
  5.2   of the residential roadway on which the speed limit applies.  
  5.3      (c) "Daytime" means from a half hour before sunrise to a 
  5.4   half hour after sunset, except at any time when due to weather 
  5.5   or other conditions there is not sufficient light to render 
  5.6   clearly discernible persons and vehicles at a distance of 500 
  5.7   feet.  "Nighttime" means at any other hour or at any time when 
  5.8   due to weather or other conditions there is not sufficient light 
  5.9   to render clearly discernible persons and vehicles at a distance 
  5.10  of 500 feet. 
  5.11     Sec. 3.  Minnesota Statutes 1994, section 169.14, 
  5.12  subdivision 5d, is amended to read: 
  5.13     Subd. 5d.  [SPEED ZONING IN WORK ZONES; SURCHARGE.] (a) The 
  5.14  commissioner, on trunk highways and temporary trunk highways, 
  5.15  and local authorities, on streets and highways under their 
  5.16  jurisdiction, may authorize the use of reduced maximum speed 
  5.17  limits in highway work zones.  The commissioner or local 
  5.18  authority is not required to conduct an engineering and traffic 
  5.19  investigation before authorizing a reduced speed limit in a 
  5.20  highway work zone. 
  5.21     (b) The minimum highway work zone speed limit is 20 miles 
  5.22  per hour.  The work zone speed limit must not reduce the 
  5.23  established speed limit on the affected street or highway by 
  5.24  more than 15 miles per hour, except that the highway work zone 
  5.25  speed limit shall not exceed 40 miles per hour.  Highway work 
  5.26  zone speed limits are effective on erection of appropriate 
  5.27  regulatory speed limit signs designating the beginning and end 
  5.28  of the affected work zone.  The signs must be removed or covered 
  5.29  when they are not required.  A speed greater than the posted 
  5.30  highway work zone speed limit is unlawful.  
  5.31     (c) For purposes of this subdivision, "highway work zone" 
  5.32  means a segment of highway or street where a road authority or 
  5.33  its agent is constructing, reconstructing, or maintaining the 
  5.34  physical structure of the roadway, its shoulders, or features 
  5.35  adjacent to the roadway, including underground and overhead 
  5.36  utilities and highway appurtenances. 
  6.1      (d) Notwithstanding section 609.0331 or 609.101 or other 
  6.2   law to the contrary, a person who violates a speed limit 
  6.3   established under paragraph (b) while on a trunk highway, or who 
  6.4   violates any other provision of this section or section 169.141 
  6.5   while in a highway work zone on a trunk highway, is assessed an 
  6.6   additional surcharge equal to the amount of the fine imposed for 
  6.7   the speed violation, but not less than $25.  The fine and 
  6.8   surcharge must be paid to the county treasurer of the county 
  6.9   where the violation occurred.  Three-eighths of these receipts 
  6.10  must be credited to the general revenue fund of the county.  The 
  6.11  other five-eighths of the receipts must be deposited in the 
  6.12  state treasury and credited to the general trunk highway fund. 
  6.13     Sec. 4.  [REPEALER.] 
  6.14     Minnesota Statutes 1994, section 169.01, subdivision 81, is 
  6.15  repealed.
