  1.1                          A bill for an act
  1.2             relating to landlords and tenants; requiring a 
  1.3             pretenancy walk-through of residential rental 
  1.4             property; requiring restitution for criminal damage to 
  1.5             leased residential rental property by a tenant; 
  1.6             amending Minnesota Statutes 1996, section 504.20, by 
  1.7             adding a subdivision; proposing coding for new law in 
  1.8             Minnesota Statutes, chapter 611A. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1996, section 504.20, is 
  1.11  amended by adding a subdivision to read: 
  1.12     Subd. 1a.  [PRETENANCY WALK-THROUGH AND CHECKLIST.] Before 
  1.13  entering into the lease agreement, whether oral or written, the 
  1.14  landlord and each tenant shall each walk through the residential 
  1.15  rental property and identify in writing all existing conditions 
  1.16  that would be considered damage to the premises.  The landlord 
  1.17  and each tenant shall sign the list of conditions existing prior 
  1.18  to beginning the tenancy and the landlord shall provide to each 
  1.19  tenant a copy of the signed list. 
  1.20     Sec. 2.  [611A.0451] [RESTITUTION; TENANT CRIMINAL DAMAGE 
  1.21  TO PROPERTY.] 
  1.22     If a tenant or a tenant's guest is convicted of violating 
  1.23  section 609.595 or an ordinance prohibiting damage to property 
  1.24  and the violation involves leased residential rental property, 
  1.25  the court shall require the convicted offender to make 
  1.26  restitution in one or more of the following ways: 
  1.27     (1) under sections 611A.04 and 611A.045; 
  2.1      (2) by being required to perform work for the owner of the 
  2.2   leased residential rental property; or 
  2.3      (3) by being required to perform community service.
