  1.1                          A bill for an act 
  1.2             relating to drivers' licenses; limiting rulemaking 
  1.3             authority concerning drivers' licenses; specifying 
  1.4             personal information to be shown on driver's license; 
  1.5             authorizing reissuance of certain drivers' licenses 
  1.6             and identification cards; amending Minnesota Statutes 
  1.7             2002, sections 171.015, by adding a subdivision; 
  1.8             171.07, subdivisions 1, 3. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2002, section 171.015, is 
  1.11  amended by adding a subdivision to read: 
  1.12     Subd. 7.  [RULEMAKING LIMITATION.] In exercising rulemaking 
  1.13  authority, the commissioner may not, in the absence of specific 
  1.14  legislative direction, include personal information that is not 
  1.15  explicitly authorized in section 171.07 on a driver's license or 
  1.16  identification card. 
  1.17     Sec. 2.  Minnesota Statutes 2002, section 171.07, 
  1.18  subdivision 1, is amended to read: 
  1.19     Subdivision 1.  [LICENSE; CONTENTS.] (a) Upon the payment 
  1.20  of the required fee, the department shall issue to every 
  1.21  qualifying applicant a license designating the type or class of 
  1.22  vehicles the applicant is authorized to drive as applied for.  
  1.23  This license must bear a distinguishing number assigned to the 
  1.24  licensee,; the full name, date of birth, residence address and 
  1.25  permanent mailing address if different,; a description of the 
  1.26  licensee in a manner as the commissioner deems necessary, which 
  1.27  consists of the applicant's height in feet and inches, weight in 
  2.1   pounds, eye color, and sex; and the usual signature of the 
  2.2   licensee.  No license is valid unless it bears the usual 
  2.3   signature of the licensee.  Every license must bear a colored 
  2.4   photograph or an electronically produced image of the licensee. 
  2.5      (b) Every license issued to an applicant under the age of 
  2.6   21 must be of a distinguishing color and plainly marked 
  2.7   "Under-21." 
  2.8      (c) The department shall use processes in issuing a license 
  2.9   that prohibit, as nearly as possible, the ability to alter or 
  2.10  reproduce a license, or prohibit the ability to superimpose a 
  2.11  photograph or electronically produced image on a license, 
  2.12  without ready detection. 
  2.13     (d) A license issued to an applicant age 65 or over must be 
  2.14  plainly marked "senior" if requested by the applicant. 
  2.15     Sec. 3.  Minnesota Statutes 2002, section 171.07, 
  2.16  subdivision 3, is amended to read: 
  2.17     Subd. 3.  [IDENTIFICATION CARD; FEE.] (a) Upon payment of 
  2.18  the required fee, the department shall issue to every qualifying 
  2.19  applicant a Minnesota identification card.  The department may 
  2.20  not issue a Minnesota identification card to a person who has a 
  2.21  driver's license, other than a limited license.  The card must 
  2.22  bear a distinguishing number assigned to the applicant; a 
  2.23  colored photograph or an electronically produced image of the 
  2.24  applicant; the applicant's full name, date of birth, and 
  2.25  residence address; a description of the applicant in the manner 
  2.26  as the commissioner deems necessary, which consists of the 
  2.27  applicant's height in feet and inches, weight in pounds, eye 
  2.28  color, and sex; and the usual signature of the applicant. 
  2.29     (b) Each identification card issued to an applicant under 
  2.30  the age of 21 must be of a distinguishing color and plainly 
  2.31  marked "Under-21." 
  2.32     (c) Each Minnesota identification card must be plainly 
  2.33  marked "Minnesota identification card - not a driver's license." 
  2.34     (d) The fee for a Minnesota identification card is 50 cents 
  2.35  when issued to a person who is mentally retarded, as defined in 
  2.36  section 252A.02, subdivision 2; a physically disabled person, as 
  3.1   defined in section 169.345, subdivision 2; or, a person with 
  3.2   mental illness, as described in section 245.462, subdivision 20, 
  3.3   paragraph (c). 
  3.4      Sec. 4.  [REISSUING DRIVER'S LICENSE OR IDENTIFICATION 
  3.5   CARD.] 
  3.6      Upon receipt of payment of the fee specified for a 
  3.7   duplicate license under Minnesota Statutes, section 171.06, and 
  3.8   surrender of the person's driver's license or identification 
  3.9   card bearing the status check notation, the commissioner shall 
  3.10  issue a duplicate driver's license or duplicate identification 
  3.11  card that does not bear a status check notation. 
  3.12     Sec. 5.  [EFFECTIVE DATE.] 
  3.13     This act is effective the day following final enactment.
