A bill for an act
relating to state government; requiring specified type of notice for termination of
the rights of former employees in the state employee group insurance program;
amending Minnesota Statutes 2010, section 43A.27, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2010, section 43A.27, is amended by adding a
subdivision to read:

new text begin This subdivision applies to a retired
employee or the spouse of a retired employee who has elected, under subdivision 3, to
purchase coverage at personal expense. The commissioner may not terminate the person's
coverage for failure to make premium payments unless the commissioner has evidence
that the person received notice of premiums due and failed to make the required premium
payments in a timely manner. For purposes of this subdivision, the commissioner
may demonstrate that the person received the notice by showing a receipt from the
United States Postal Service, signed by the person whose coverage is being canceled,
demonstrating that the person received the premium notice.

and applies to terminations on and after that date.

Sec. 2. new text begin REINSTATEMENT OF COVERAGE.

new text begin (a) The commissioner of management and budget must reinstate coverage under
the state employee group insurance program (SEGIP) for a person and the spouse of a
person who: (1) made premiums payments for SEGIP coverage for October 2010; and (2)
submits a written and signed statement to the commissioner of management and budget
stating that the person did not receive premium notices from SEGIP for November 2010.

new text begin (b) Paragraph (a) does not apply if the commissioner of management and budget
demonstrates that the person signed a receipt from the United States Postal Service
indicating that the person received the notice of premiums due for November 2010.

Within ten days of the effective date of this section, the commissioner of management
and budget must notify a person covered by this section of the opportunity to reinstate
coverage. The reinstated coverage is effective upon receipt of premium payments.
