  1.1                          A bill for an act 
  1.2             relating to veterans homes; updating and correcting 
  1.3             certain language; amending Minnesota Statutes 2002, 
  1.4             sections 198.001, by adding a subdivision; 198.004, 
  1.5             subdivision 1; 198.005; 198.007; repealing Minnesota 
  1.6             Statutes 2002, sections 198.001, subdivision 7; 
  1.7             198.002, subdivision 5; 198.003, subdivision 2. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2002, section 198.001, is 
  1.10  amended by adding to subdivision to read: 
  1.11     Subd. 9.  [EXECUTIVE DIRECTOR.] "Executive director" means 
  1.12  the executive director for the board of directors of the 
  1.13  Minnesota veterans homes.  
  1.14     Sec. 2.  Minnesota Statutes 2002, section 198.004, 
  1.15  subdivision 1, is amended to read: 
  1.16     Subdivision 1.  [APPOINTMENT.] The board shall appoint an 
  1.17  executive director.  The executive director shall serve in the 
  1.18  unclassified service at the pleasure of the board.  The 
  1.19  executive director must be a resident of the state of Minnesota, 
  1.20  a citizen of the United States, a licensed nursing home 
  1.21  administrator, and a veteran as that term is defined in section 
  1.22  197.447.  The executive director shall serve as secretary of the 
  1.23  board. 
  1.24     Sec. 3.  Minnesota Statutes 2002, section 198.005, is 
  1.25  amended to read: 
  1.26     198.005 [ADMINISTRATORS.] 
  2.1      The board shall appoint an administrator for each of the 
  2.2   veterans homes.  The administrators act as the administrative 
  2.3   head for their respective veterans homes.  The administrators 
  2.4   shall have a current Minnesota nursing home administrator's 
  2.5   license and shall serve in the unclassified service.  The 
  2.6   salaries of the administrators are not subject to section 
  2.7   43A.17, subdivision 1.  The administrators serve at the pleasure 
  2.8   of the board and report directly to the executive director.  
  2.9      Sec. 4.  Minnesota Statutes 2002, section 198.007, is 
  2.10  amended to read: 
  2.11     198.007 [QUALITY ASSURANCE.] 
  2.12     The board Each home shall create have a utilization review 
  2.13  committee for each home comprised of the appropriate 
  2.14  professionals employed by or under contract to the home.  The 
  2.15  committee shall use the case-mix a patient classification system 
  2.16  established under section 144.072 approved by the board to 
  2.17  assess the appropriateness and quality of care and services 
  2.18  provided residents of the homes. 
  2.19     The board Each home shall create have an admissions 
  2.20  committee for each home comprised of the appropriate 
  2.21  professionals employed by or under contract to each home and 
  2.22  adopt a preadmission screening program for all applicants for 
  2.23  admission to the homes who may require nursing or boarding care, 
  2.24  taking into account the eligibility requirements in section 
  2.25  198.022, the admissions criteria established by board rules, and 
  2.26  the availability of space in the homes.  
  2.27     Sec. 5.  [REPEALER.] 
  2.28     Minnesota Statutes 2002, sections 198.001, subdivision 7; 
  2.29  198.002, subdivision 5; and 198.003, subdivision 2, are repealed.
