1.1 A bill for an act 1.2 proposing amendments to the Minnesota Constitution, 1.3 article XI, section 14, and article XIII, by adding a 1.4 section; extending until the year 2020 the period 1.5 during which at least 40 percent of the net proceeds 1.6 from the state lottery must be credited to the 1.7 environment and natural resources trust fund; 1.8 modifying authority for appropriations from the fund; 1.9 affirming the privilege of citizens to take game and 1.10 fish and to gather. 1.11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.12 Section 1. [CONSTITUTIONAL AMENDMENT PROPOSED.] 1.13 An amendment to the Minnesota Constitution, article XI, 1.14 section 14, is proposed to the people. If the amendment is 1.15 adopted, the section will read as follows: 1.16 Sec. 14. A permanent Minnesota environment and natural 1.17 resources trust fund is established in the state treasury. The 1.18 principal of the environment and natural resources trust fund 1.19 must be perpetual and inviolate forever, except appropriations 1.20 may be made from up to 25 percent of the annual revenues 1.21 deposited in the fund until fiscal year
19972020 for land 1.22 acquisition and development and loans may be made of up to five 1.23 percent of the principal of the fund for water system 1.24 improvements as provided by law. This restriction does not 1.25 prevent the sale of investments at less than the cost to the 1.26 fund, however, all losses not offset by gains shall be repaid to 1.27 the fund from the earnings of the fund. The net earnings from 1.28 the fund shall be appropriated in a manner prescribed by law for 2.1 the public purpose of protection, conservation, preservation, 2.2 and enhancement of the state's air, water, land, fish, wildlife, 2.3 and other natural resources. Not less than 40 percent of the 2.4 net proceeds from any state-operated lottery must be credited to 2.5 the fund until the year 20012020. 2.6 Sec. 2. [SUBMISSION TO VOTERS.] 2.7 The proposed amendment must be submitted to the people at 2.8 the 1998 general election. The question submitted shall be: 2.9 "Shall the Minnesota Constitution be amended to extend 2.10 until the year 2020 the period during which at least 40 percent 2.11 of the net proceeds from the state lottery must be credited to 2.12 the environment and natural resources trust fund? 2.13 Yes ....... 2.14 No ........" 2.15 Election procedures shall be as provided by law. 2.16 Sec. 3. [CONSTITUTIONAL AMENDMENT PROPOSED.] 2.17 An amendment to the Minnesota Constitution, article XIII, 2.18 by adding a section, is proposed to the people. If the 2.19 amendment is adopted, the section will read as follows: 2.20 Sec. 12. The citizens of this state, who are considered to 2.21 be equal regardless of gender, have the privilege to take game 2.22 and fish and to gather in accordance with law and regulations. 2.23 No new right is intended to be granted, nor any existing right 2.24 impaired, by this declaration. 2.25 Sec. 4. [SUBMISSION TO VOTERS.] 2.26 The proposed amendment must be submitted to the people at 2.27 the 1998 general election. The question submitted shall be: 2.28 "Shall the Minnesota Constitution be amended to affirm the 2.29 privilege of citizens, who are considered to be equal regardless 2.30 of gender, to take game and fish and to gather in accordance 2.31 with law and regulations? 2.32 Yes ....... 2.33 No ........"
