  1.1                          A bill for an act 
  1.2             relating to gambling; authorizing fantasy sports 
  1.3             leagues; amending Minnesota Statutes 2002, sections 
  1.4             340A.410, subdivision 5; 609.761, by adding a 
  1.5             subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 340A.410, 
  1.8   subdivision 5, is amended to read: 
  1.9      Subd. 5.  [GAMBLING PROHIBITED.] (a) Except as otherwise 
  1.10  provided in this subdivision, no retail establishment licensed 
  1.11  to sell alcoholic beverages may keep, possess, or operate, or 
  1.12  permit the keeping, possession, or operation on the licensed 
  1.13  premises of dice or any gambling device as defined in section 
  1.14  349.30, or permit gambling therein.  
  1.15     (b) Gambling equipment may be kept or operated and raffles 
  1.16  conducted on licensed premises and adjoining rooms when the use 
  1.17  of the gambling equipment is authorized by (1) chapter 349, (2) 
  1.18  a tribal ordinance in conformity with the Indian Gaming 
  1.19  Regulatory Act, Public Law Number 100-497, or (3) a tribal-state 
  1.20  compact authorized under section 3.9221. 
  1.21     (c) Lottery tickets may be purchased and sold within the 
  1.22  licensed premises as authorized by the director of the lottery 
  1.23  under chapter 349A.  
  1.24     (d) Dice may be kept and used on licensed premises and 
  1.25  adjoining rooms as authorized by section 609.761, subdivision 4. 
  2.1      (e) Fantasy sports leagues may be hosted on licensed 
  2.2   premises under section 609.761, subdivision 6. 
  2.3      Sec. 2.  Minnesota Statutes 2002, section 609.761, is 
  2.4   amended by adding a subdivision to read: 
  2.5      Subd. 6.  [FANTASY SPORTS LEAGUES.] Sections 609.755 and 
  2.6   609.76 do not prohibit a retail establishment licensed to sell 
  2.7   alcoholic beverages from hosting a fantasy sports league if the 
  2.8   following conditions are satisfied: 
  2.9      (1) the total value of payouts to all league members is 
  2.10  equal to the total amounts paid in by all members; 
  2.11     (2) the maximum payout to any single individual does not 
  2.12  exceed $250; and 
  2.13     (3) the retail establishment organizing the game has no 
  2.14  interest in the outcome of or participates financially in the 
  2.15  game and does not handle any of the league's funds. 
  2.16  This subdivision does not authorize the betting or wagering on 
  2.17  the outcome of an individual sporting event or activities 
  2.18  unlawful under section 609.76, subdivision 2. 
  2.19     Sec. 3.  [EFFECTIVE DATE.] 
  2.20     Section 2 is effective the day following final enactment.
