A bill for an act
relating to transportation; highways; requiring periodic review of property
owned or controlled by the department for the purpose of determining surplus;
requiring a report; amending Minnesota Statutes 2012, section 161.44, by adding
a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2012, section 161.44, is amended by adding a
subdivision to read:

new text begin (a) The commissioner shall examine all real property
owned by the state and under the custodial control of the department to decide whether
any real property may be declared as surplus and suitable for sale or some other means of
disposal.

new text begin (b) The commissioner shall report its findings under paragraph (a) to the house
of representatives and senate committees with jurisdiction over transportation policy
and finance by March 1 of each odd-numbered year. The report may be submitted
electronically, and is subject to section 3.195, subdivision 1.

new text begin (c) For purposes of this subdivision, "surplus" means real property that is no longer
needed for state highway purposes, and that has not been used for state highway purposes
for the previous five years.
