A bill for an act
relating to environment; prohibiting unproductive conservation lands from being
considered benefited property under state drainage laws; proposing coding for new
law in Minnesota Statutes, chapter 103E.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

[103E.026] UNPRODUCTIVE CONSERVATION LANDS ARE NOT
BENEFITED BY DRAINAGE PROJECTS OR REPAIRS.

Notwithstanding any provision of this chapter to the contrary, any determination of
benefits under this chapter, whether for a drainage project or for repairing a drainage system,
must not include a determination that property is benefited if the property is subject to a
conservation easement.
