A bill for an act
relating to public safety; establishing a task force to review and evaluate the
standards and training of school resource officers and the relationship between
schools and officers; requiring a report.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

new text begin The School Resource Officers Task Force
is established to identify, review, evaluate, and recommend standards and training
requirements for school resource officers.

new text begin Subd. 2. new text end

new text begin Membership; meetings; staff. new text end

new text begin (a) The task force shall be composed of
22 members:
new text end

new text begin (1) the director of the Minnesota School Safety Center;
new text end

new text begin (2) the commissioner of education or the commissioner's designee;
new text end

new text begin (3) one member appointed by the Board of Peace Officer Standards and Training;
new text end

new text begin (4) one sheriff appointed by the governor;
new text end

new text begin (5) one peace officer appointed by the Minnesota Chiefs of Police Association;
new text end

new text begin (6) one school administrator appointed by the Minnesota Association of School
Administrators;
new text end

new text begin (7) two school resource officers appointed by the Minnesota Police and Peace
Officers Association;
new text end

new text begin (8) two licensed teachers, one from a traditional kindergarten through grade 12
public school setting and one from an intermediate school district or public alternative
learning center or program, appointed by Education Minnesota;

new text begin (9) one school counselor appointed by the Minnesota School Counselors Association;
new text end

new text begin (10) one attorney appointed by the Minnesota Disability Law Center;
new text end

new text begin (11) one licensed practitioner appointed by the National Association of Mental
Illness Minnesota;

new text begin (12) one elementary school principal appointed by the Minnesota Elementary
School Principals' Association;
new text end

new text begin (13) one secondary school principal appointed by the Minnesota Association of
Secondary School Principals;
new text end

new text begin (14) one member appointed by the governor representing the Minnesota Native
American community;
new text end

new text begin (15) one member appointed by the governor representing the Minnesota
African-American community;
new text end

new text begin (16) one member appointed by the governor representing the Minnesota Latino
community;
new text end

new text begin (17) one member appointed by the governor representing the Minnesota
Asian-Pacific community; and
new text end

new text begin (18) three students or recent students who have graduated from a Minnesota
public high school within five years of the effective date of this act, one each from a
rural, suburban, and urban area of the state, appointed by the Juvenile Justice Advisory
Committee.

new text begin (b) Members must be appointed by the appointing authority by July 1, 2016, and
serve at the pleasure of the appointing authority. A vacancy shall be filled by appointment
of the appointing authority for the vacating member.

new text begin (c) The commissioner of public safety, at the request of the task force, shall provide
staff and technical assistance necessary for the task force to carry out its duties.

new text begin (d) The director of the Minnesota School Safety Center shall convene the first
meeting of the task force by August 1, 2016. The task force shall elect a chair from its
members at the first meeting.

new text begin (e) The Department of Public Safety may use existing resources to compensate
members of the task force under Minnesota Statutes, section 15.059, subdivision 3.

new text begin Duties. new text end

new text begin (a) The duties of the task force shall, at a minimum, include:
new text end

new text begin (1) recommending strategies to increase diversity among school resource officers by
considering how to assign school resource officers so that the demographic characteristics
of the officer reflect the demographic characteristics of the majority of students attending
the school served by the officer;
new text end

new text begin (2) reviewing and evaluating the 2014 Department of Public Safety statewide
survey of state resource officers entitled "Law Enforcement in Minnesota Schools: A
Statewide Survey of School Resource Officers" and considering if and how to implement
recommendations made in the report;

new text begin (3) recommending statewide standards as to how and when school resource officers
should participate in student discipline in school, including but not limited to student
dismissal from school under Minnesota Statutes, sections 121A.40 to 121A.56, among
other student discipline provisions in chapter 121A;

new text begin (4) reviewing and recommending a written operating protocol in the memorandum
of understanding between a school and a law enforcement agency;
new text end

new text begin (5) reviewing and recommending criteria for selecting school resource officers;
new text end

new text begin (6) developing and recommending a training protocol; and
new text end

new text begin (7) reviewing and recommending best practices for school resource officers.

new text begin (b) At its discretion, the task force may examine other related issues consistent
with this section.

new text begin By February 1, 2017, the task force shall submit a written report
consistent with this section to the chairs and ranking minority members of the house of
representatives and senate committees and divisions with primary jurisdiction over public
safety and kindergarten through grade 12 education.

new text begin The task force sunsets the day after submitting its report under
subdivision 4 or February 2, 2017, whichever is earlier.
