1.2relating to occupational licensing; modifying electrical licenses;amending
1.3Minnesota Statutes 2010, sections 326B.31, subdivision 14, by adding
1.4subdivisions; 326B.33, subdivisions 17, 19, by adding a subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 326B.31, subdivision 14, is amended to
1.7read:
1.8    Subd. 14. Contractor. "Contractor" means a person who performs or offers to
1.9perform any electrical work, with or without compensation, who is licensed as a contractor
1.10by the commissioner. A contractor's license does not of itself qualify its holder to perform
1.11or supervise the electrical work authorized by holding any class of electrician's or other
1.12personal license. Contractor includes electrical contractors, satellite system contractors,
1.13and technology system contractors.

1.14    Sec. 2. Minnesota Statutes 2010, section 326B.31, is amended by adding a subdivision
1.15to read:
1.16    Subd. 31. Satellite broadcast communication system. "Satellite broadcast
1.17communication system" means antenna and receiving equipment for a residential dwelling
1.18to receive and transmit communication signals from satellite sources as covered by
1.19the National Electrical Code. Satellite broadcast communication system is a subset of
1.20technology circuits and systems.

1.21    Sec. 3. Minnesota Statutes 2010, section 326B.31, is amended by adding a subdivision
1.22to read:
2.1    Subd. 32. Satellite system installer. "Satellite system installer" means an individual
2.2having the necessary training, knowledge, and experience to plan, lay out, supervise,
2.3and install, maintain, and repair wiring, apparatus, and equipment for satellite broadcast
2.4communication systems.

2.5    Sec. 4. Minnesota Statutes 2010, section 326B.31, is amended by adding a subdivision
2.6to read:
2.7    Subd. 33. Satellite system contractor. "Satellite system contractor" means a
2.8licensed contractor whose responsible licensed individual is a licensed satellite system
2.9installer.

2.10    Sec. 5. Minnesota Statutes 2010, section 326B.33, is amended by adding a subdivision
2.11to read:
2.12    Subd. 7a. Satellite system installer. (a) Except as otherwise provided by law, no
2.13individual shall install, alter, repair, plan, lay out, or supervise the installing, altering,
2.14repairing, planning, or laying out of electrical wiring, apparatus, or equipment for satellite
2.15broadcast communication systems unless:
2.16(1) the electrical work is for a licensed contractor and the individual is an employee,
2.17partner, or officer of, or is the licensed contractor; and
2.18(2)(i) the individual provides certification to the department demonstrating
2.19successful completion of the National Standards and Testing Program for satellite system
2.20installers sponsored by the Satellite Broadcasting and Communications Association of
2.21America, Inc. or other program approved by the board and (ii) has passed an examination
2.22administered by the commissioner.
2.23(b) Individuals who fulfill the requirements of this subdivision under paragraph (a),
2.24clause (2), are prohibited from performing any other function allowed under the power
2.25limited technician license.
2.26(c) Satellite system installers shall be subject to the fees provided for under section
2.27326B.33, subdivision 19, paragraph (b), clause (2).
2.28(d) Satellite system installers must attain four hours of continuing education under
2.29rules adopted by the Board of Electricity.

2.30    Sec. 6. Minnesota Statutes 2010, section 326B.33, subdivision 17, is amended to read:
2.31    Subd. 17. Employment of master electrician, satellite system installer, or power
2.32limited technician. (a) Each contractor must designate a responsible master electrician,
2.33satellite system installer, or power limited technician, who shall be responsible for the
3.1performance of all electrical work in accordance with the requirements of sections
3.2326B.31 to 326B.399, all rules adopted under these sections, and all orders issued under
3.3section 326B.082. The classes of work that a licensed contractor is authorized to perform
3.4shall be limited to the classes of work that the responsible master electrician, satellite
3.5system installer, or power limited electrician is licensed to perform.
3.6    (b) When a contractor's license is held by an individual, sole proprietorship,
3.7partnership, limited liability company, or corporation and the individual, proprietor,
3.8one of the partners, one of the members, or an officer of the corporation, respectively,
3.9is not the responsible master electrician or power limited technician, all requests for
3.10inspection shall be signed by the responsible master electrician, satellite system installer,
3.11 or power limited technician. If the contractor is an individual or a sole proprietorship, the
3.12responsible licensed individual must be the individual, proprietor, or managing employee.
3.13If the contractor is a partnership, the responsible licensed individual must be a general
3.14partner or managing employee. If the licensed contractor is a limited liability company,
3.15the responsible licensed individual must be a chief manager or managing employee. If
3.16the contractor is a corporation, the responsible licensed individual must be an officer or
3.17managing employee. If the responsible licensed individual is a managing employee, the
3.18responsible licensed individual must be actively engaged in performing electrical work on
3.19behalf of the contractor, and cannot be employed in any capacity as an electrician, installer,
3.20 or technician by any other contractor or employer designated in subdivision 21. An
3.21individual may be the responsible licensed individual for only one contractor or employer.
3.22    (c) All applications and renewals for contractor licenses shall include a verified
3.23statement that the applicant or licensee has complied with this subdivision.

3.24    Sec. 7. Minnesota Statutes 2010, section 326B.33, subdivision 19, is amended to read:
3.25    Subd. 19. License, registration, and renewal fees; expiration. (a) Unless
3.26revoked or suspended under this chapter, all licenses issued or renewed under this section
3.27expire on the date specified in this subdivision. Master licenses expire March 1 of each
3.28odd-numbered year after issuance or renewal. Electrical contractor licenses expire March
3.291 of each even-numbered year after issuance or renewal. Technology system contractor
3.30and satellite system contractor licenses expire August 1 of each even-numbered year after
3.31issuance or renewal. All other personal licenses expire two years from the date of original
3.32issuance and every two years thereafter. Registrations of unlicensed individuals expire
3.33one year from the date of original issuance and every year thereafter.
3.34(b) For purposes of calculating license fees and renewal license fees required under
3.35section 326B.092:
4.1(1) the registration of an unlicensed individual under subdivision 12 shall be
4.2considered an entry level license;
4.3(2) the following licenses shall be considered journeyman licenses: Class A
4.4journeyman electrician, Class B journeyman electrician, Class A installer, Class B
4.5installer, elevator constructor, lineman, maintenance electrician, satellite system installer,
4.6and power limited technician;
4.7(3) the following licenses shall be considered master licenses: Class A master
4.8electrician, Class B master electrician, and master elevator constructor; and
4.9(4) the following licenses shall be considered business licenses: Class A electrical
4.10contractor, Class B electrical contractor, elevator contractor, satellite system contractor,
4.11and technology systems contractor.
4.12(c) For each filing of a certificate of responsible person by an employer, the fee is
4.13$100.

4.14    Sec. 8. EFFECTIVE DATE.
4.15Sections 1 to 7 are effective October 1, 2012.
