  1.1                          A bill for an act 
  1.2             relating to state government; revising conditions 
  1.3             under which public employees receive daily payments 
  1.4             for service on boards and councils; requiring groups 
  1.5             to adopt standards for daily payments; amending 
  1.6             Minnesota Statutes 2000, sections 15.0575, subdivision 
  1.7             3; 15.059, subdivision 3; and 214.09, subdivision 3. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2000, section 15.0575, 
  1.10  subdivision 3, is amended to read: 
  1.11     Subd. 3.  [COMPENSATION.] (a) Members of the boards must 
  1.12  may be compensated at the rate of $55 a day spent on board 
  1.13  activities, when authorized by the board, plus expenses in the 
  1.14  same manner and amount as authorized by the commissioner's plan 
  1.15  adopted under section 43A.18, subdivision 2.  Members who, as a 
  1.16  result of time spent attending board meetings, incur child care 
  1.17  expenses that would not otherwise have been incurred, may be 
  1.18  reimbursed for those expenses upon board authorization.  
  1.19     (b) Members who are full-time state employees or full-time 
  1.20  employees of the political subdivisions of the state may must 
  1.21  not receive the daily payment, but they may suffer no loss in 
  1.22  compensation or benefits from the state or a political 
  1.23  subdivision as a result of their service on the board for 
  1.24  activities that occur during working hours for which they are 
  1.25  compensated by the state or political subdivision.  However, a 
  1.26  state or political subdivision employee may receive the daily 
  2.1   payment if the employee uses vacation time for board 
  2.2   activities.  Members who are full-time state employees 
  2.3   or full-time employees of the political subdivisions of the 
  2.4   state may receive the expenses provided for in this subdivision 
  2.5   unless the expenses are reimbursed by another source.  Members 
  2.6   who are state employees or employees of political subdivisions 
  2.7   of the state may be reimbursed for child care expenses only for 
  2.8   time spent on board activities that are outside their normal 
  2.9   working hours. 
  2.10     (c) Each board must adopt internal standards prescribing 
  2.11  what constitutes a day spent on board activities for purposes of 
  2.12  making daily payments under this subdivision. 
  2.13     Sec. 2.  Minnesota Statutes 2000, section 15.059, 
  2.14  subdivision 3, is amended to read: 
  2.15     Subd. 3.  [COMPENSATION.] (a) Members of the advisory 
  2.16  councils and committees must may be compensated at the rate of 
  2.17  $55 a day spent on council or committee activities, when 
  2.18  authorized by the council or committee, plus expenses in the 
  2.19  same manner and amount as authorized by the commissioner's plan 
  2.20  adopted under section 43A.18, subdivision 2.  Members who, as a 
  2.21  result of time spent attending council or committee meetings, 
  2.22  incur child care expenses that would not otherwise have been 
  2.23  incurred, may be reimbursed for those expenses upon council or 
  2.24  committee authorization.  
  2.25     If (b) Members who are state employees or employees of 
  2.26  political subdivisions must not receive the daily compensation, 
  2.27  and if the major part of their for activities that occur during 
  2.28  normal working hours for which they are also compensated by the 
  2.29  state or political subdivision, the employer shall deduct the 
  2.30  daily compensation from the employee's compensation for the 
  2.31  day.  In no other case may a member who is an employee of the 
  2.32  state or a political subdivision suffer a loss in compensation 
  2.33  or benefits from the state or political subdivision as a result 
  2.34  of service on the council or committee.  However, a state or 
  2.35  political subdivision employee may receive the daily payment if 
  2.36  the employee uses vacation time for council or committee 
  3.1   activity.  Members who are full-time state employees 
  3.2   or full-time employees of the political subdivisions of the 
  3.3   state may receive the expenses provided for in this section 
  3.4   unless the expenses are reimbursed by another source.  Members 
  3.5   who are state employees or employees of political subdivisions 
  3.6   of the state may be reimbursed for child care expenses only for 
  3.7   time spent on board activities that are outside their normal 
  3.8   working hours.
