A bill for an act
relating to state government; providing that no civil or criminal penalties may
be imposed or citations issued for certain conduct when state agencies were not
issuing required licenses and permits.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin NO CIVIL OR CRIMINAL PENALTY.

new text begin Notwithstanding any law to the contrary, a state agency or a unit of local government
may not impose a civil fine or penalty, issue a citation, or seek a criminal penalty against
a person or entity for engaging in conduct after June 30, 2011, and before the day of
enactment of this section, without a license or permit required by state law if:

new text begin (1) the person or entity had a valid license or permit to engage in the conduct on
June 30, 2011, and the license or permit expired after June 30, 2011, and before the day
of enactment of this section, or the person or entity was entitled to issuance of a new
license or permit upon payment of a fee without further discretionary action on the part
of the state agency; and

new text begin (2) the state agency responsible for issuance or renewal of the license or permit was
not issuing or renewing licenses or permits after June 30, 2011; and

new text begin (3) the conduct engaged in by the person or entity would have been legal if the
person or entity had a valid license or permit during the period in which the state agency
was not issuing licenses or permits; and

new text begin (4) the person or entity obtains the required license or permit before September 1,
2011.
