A bill for an act
relating to education; allowing schools to maintain a supply of asthma inhalers;
proposing coding for new law in Minnesota Statutes, chapter 121A.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Notwithstanding
section 151.37, districts and schools may obtain and possess asthma inhalers to be maintained
and administered by school personnel to a student or other individual if, in good faith, it is
determined that the person is experiencing an asthma attack or exacerbation regardless of
whether the student or other individual has a prescription for an asthma inhaler. The
administration of an asthma inhaler in accordance with this section is not the practice of
medicine.

A district or school may enter into
arrangements with manufacturers of asthma inhalers to obtain asthma inhalers at fair-market,
free, or reduced prices. A third party, other than a manufacturer or supplier, may pay for a
school's supply of asthma inhalers.
