A bill for an act
relating to mental health; providing for sharing of certain mental health data on
prisoners; amending Minnesota Statutes 2016, sections 13.851, by adding a
subdivision; 641.15, subdivision 3a.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2016, section 13.851, is amended by adding a subdivision
to read:

the sharing of mental health data on prisoners with county social service agencies.

Sec. 2.

Minnesota Statutes 2016, section 641.15, subdivision 3a, is amended to read:


Subd. 3a.

Intake procedure; approved mental health screeningnew text begin ; data sharingnew text end .

new text end As part of its intake procedure for new prisoners, the sheriff or local corrections shall use
a mental health screening tool approved by the commissioner of correctionsnew text begin ,new text end in consultation
with the commissioner of human services and local corrections staffnew text begin ,new text end to identify persons
who may have new text begin a new text end mental illness.

new text begin (b) Notwithstanding section 13.85, the sheriff or local corrections agency shall provide
the county social services agency with the names of persons who may have a mental illness
and are reasonably likely to need treatment or other services. The sheriff or local corrections
agency may share additional data on a person with the county social service agency to the
extent necessary to assess whether the person is in need of treatment or services and to
coordinate treatment in the jail and referrals, case management, and other services upon the
person's release.
