A bill for an act
relating to child care regulations; amending staffing and group size requirements
for certified, license-exempt child care centers; amending Minnesota Statutes 2020,
section 245H.08, by adding a subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2020, section 245H.08, is amended by adding a subdivision
to read:

Notwithstanding subdivisions 4 and 5,
for children in kindergarten through 13 years old, the commissioner may increase the
maximum group size to no more than 40 children and may increase the minimally acceptable
staff-to-child ratio to 1:20 during a national security or peacetime emergency declared under
section 12.31, or during a public health emergency declared due to a pandemic by the United
States Secretary of Health and Human Services under section 319 of the Public Health
Service Act, United States Code, title 42, section 247d.
