A bill for an act
relating to state government; prohibiting an agency from procuring supplies or
services from persons that fail to disclose as required by federal law information
relating to conflict minerals originating in the Democratic Republic of the
Congo or its neighboring countries; requiring an agency to provide notice of the
prohibition in any solicitation for supplies or services; proposing coding for new
law in Minnesota Statutes, chapter 16C.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Definitions. new text end

new text begin (a) For purposes of this section, the following terms
have the meanings given them.

new text begin (b) "Conflict mineral" means a mineral or mineral derivative determined under
federal law to be financing human conflict. Conflict mineral includes columbite-tantalite
(coltan), cassiterite, gold, wolframite, or derivatives of those minerals.

new text begin (c) "Noncompliant person" means a person:

new text begin (1) who is required to disclose under federal law information relating to conflict
minerals that originated in the Democratic Republic of the Congo or its neighboring
countries; and

new text begin (2) for whom the disclosure is not filed, is considered under federal law to be an
unreliable determination, or contains false information.

new text begin No commissioner may knowingly procure supplies or
services from a noncompliant person.

new text begin In any solicitation for supplies or services, a commissioner shall
provide notice of the requirements of this section.
