A bill for an act
relating to redistricting; requiring the exclusion of persons incarcerated in state
or federal correctional facilities from population counts used for state and local
redistricting; proposing coding for new law in Minnesota Statutes, chapter 2.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin When redistricting may begin. new text end

new text begin A redistricting plan for seats in the
legislature or the governing body of a political subdivision may not be adopted until the
United States Bureau of the Census has published a table of group quarters showing the
population count for each state or federal correctional facility in this state according
to the decennial federal census.

new text begin Incarcerated persons; exclusion. new text end

new text begin If the census block populations
provided to this state by the United States Bureau of the Census under Public Law 94-171,
codified as United States Code, title 13, section 141, include persons incarcerated in
a state or federal correctional facility and count those persons at the facility where they
are incarcerated, the Legislative Coordinating Commission shall remove from the count
of the census block where the facility is located the number of persons incarcerated
there. The population counts that exclude these incarcerated persons must be posted on
the Legislative Coordinating Commission's Web site within seven days after the group
quarters population counts of incarcerated persons are published by the Census Bureau.

exclude these incarcerated persons must be used by the legislature when drawing
legislative districts and by political subdivisions when drawing city wards and other
local government election districts.

new text begin This act is effective January 1, 2011, and applies to redistricting plans based on the
2010 federal decennial census and thereafter.
