  1.1                          A bill for an act 
  1.2             relating to crimes; repealing the law prohibiting 
  1.3             endurance contests and striking a reference to it in 
  1.4             law; amending Minnesota Statutes 2000, section 375.40; 
  1.5             repealing Minnesota Statutes 2000, section 624.66. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 375.40, is 
  1.8   amended to read: 
  1.9      375.40 [COUNTY BOARD MAY LICENSE EXHIBITIONS AND SHOWS.] 
  1.10     A county board may license and regulate itinerant shows, 
  1.11  carnivals, circuses, endurance contests, and exhibitions of any 
  1.12  nature whatsoever, except those prohibited by section 624.66.  
  1.13  Sections 375.40 to 375.42 do not apply to shows, carnivals, 
  1.14  circuses, contests, and exhibitions held within the incorporated 
  1.15  limits of a city.  
  1.16     The fee for a license shall be fixed by the county board in 
  1.17  the amount it deems advisable.  
  1.18     The board may require, as a condition for granting the 
  1.19  license, the posting of a penal bond in the amount it shall 
  1.20  determine.  
  1.21     Application for a license shall be made on the form the 
  1.22  county board determines.  Upon approval of an application and 
  1.23  the payment of the license fee and the posting of the required 
  1.24  bond, the county auditor shall issue the license. 
  1.25     Sec. 2.  [REPEALER.] 
  2.1      Minnesota Statutes 2000, section 624.66, is repealed.
