  1.1                          A bill for an act 
  1.2             relating to education; detaching land from independent 
  1.3             school district No. 11, Anoka-Hennepin, for two new 
  1.4             school districts. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [DETACHMENT; ANOKA-HENNEPIN.] 
  1.7      (a) The following areas shall be detached from independent 
  1.8   school district No. 11, Anoka-Hennepin, and shall be classified 
  1.9   as a new independent school district, and assigned an 
  1.10  identification number, by the commissioner of children, 
  1.11  families, and learning: 
  1.12     (1) all of the area of the current school district that is 
  1.13  also encompassed within the city of Champlin; and 
  1.14     (2) all of the area of the current school district that is 
  1.15  also encompassed within the city of Dayton; and 
  1.16     (3) all of the area of the current school district that is 
  1.17  also encompassed within the city of Coon Rapids except that part 
  1.18  north of route 14 (Main Street). 
  1.19     (b) The remaining areas of independent school district No. 
  1.20  11, Anoka-Hennepin, shall be classified as a new independent 
  1.21  school district, and assigned an identification number, by the 
  1.22  commissioner of children, families, and learning. 
  1.23     [EFFECTIVE DATE.] This section is effective for the 
  1.24  2006-2007 school year and later.  Upon the effective date of 
  1.25  this section, the commissioner shall modify the records and any 
  2.1   plats, petitions, and proceedings involving the affected 
  2.2   districts in order to conform with this section. 
  2.3      Sec. 2.  [SCHOOL BOARD ELECTIONS.] 
  2.4      A board of directors for the new school district described 
  2.5   in section 1, paragraph (a), and a board of directors for the 
  2.6   newly reconstituted Anoka-Hennepin school district, shall be 
  2.7   elected pursuant to Minnesota Statutes, chapter 205A, and 
  2.8   elections shall be conducted by resolution of the county board 
  2.9   in which a majority of the new school district resides and the 
  2.10  county board in which a majority of the newly reconstituted 
  2.11  Anoka-Hennepin school district resides.  One-half of the initial 
  2.12  board members on each board shall be elected to two-year terms 
  2.13  and one-half of the initial members shall be elected to 
  2.14  four-year terms.  The terms of the members must begin on the 
  2.15  first Monday in January and until a successor qualifies.  
  2.16  Thereafter the terms of all the members shall be as governed 
  2.17  under Minnesota Statutes, section 123B.09. 
  2.18     [EFFECTIVE DATE.] This section is effective the day 
  2.19  following final enactment. 
  2.20     Sec. 3.  [TAX LIABILITY FOR EXISTING BONDED DEBT.] 
  2.21     All taxable property in the area so detached remains 
  2.22  obligated for any bonded debt incurred to which the property was 
  2.23  subject prior to the effective date of this section.  All 
  2.24  taxable property in the former district is taxable for payment 
  2.25  of any school district obligations authorized on or subsequent 
  2.26  to the effective date of this section by the new respective 
  2.27  districts. 
  2.28     Sec. 4.  [CURRENT ASSETS AND LIABILITIES.] 
  2.29     Subdivision 1.  [DISTRIBUTION OF ASSETS.] Under the 
  2.30  detachment in section 1, the commissioner of children, families, 
  2.31  and learning shall issue an order for the division and 
  2.32  distribution of the current assets and liabilities, real and 
  2.33  personal, and the legally valid and enforceable claims and 
  2.34  contract obligations of the former independent school district 
  2.35  No. 11, Anoka-Hennepin, that are necessary for the new school 
  2.36  districts to operate as separate units. 
  3.1      Subd. 2.  [REAL PROPERTY.] The commissioner's order must 
  3.2   transfer the interest in real estate to each new district.  This 
  3.3   order may also impose a dollar amount as a claim against the 
  3.4   district receiving the new property in favor of the other 
  3.5   district, and this claim shall be paid and enforced in the 
  3.6   manner provided by law for the payment of judgments against a 
  3.7   district.  The commissioner shall determine the distribution of 
  3.8   property and amount paid for the property, if any. 
  3.9      [EFFECTIVE DATE.] This section is effective the day 
  3.10  following final enactment and applies to the reconstituted 
  3.11  Anoka-Hennepin school district and the new school district 
  3.12  described under section 1. 
  3.13     Sec. 5.  [LICENSED AND NONLICENSED EMPLOYEES.] 
  3.14     (a) The obligations of the newly reconstituted 
  3.15  Anoka-Hennepin school district and the new school district to 
  3.16  the teachers employed in schools located in the areas detached 
  3.17  from the Anoka-Hennepin school district under section 1 must be 
  3.18  governed by Minnesota Statutes, section 123A.75.  
  3.19     (b) Under the detachment in section 1, the nonlicensed 
  3.20  employees may apply to remain with the newly reconstituted 
  3.21  Anoka-Hennepin school district or move to the new school 
  3.22  district described in section 1, paragraph (a).  The 
  3.23  commissioner shall assign nonlicensed employees of the 
  3.24  independent school district No. 11, Anoka-Hennepin, to unfilled 
  3.25  positions in the new district in order of seniority.  All the 
  3.26  rights and obligations of the nonlicensed employees must 
  3.27  continue in the same manner as before the effective date of the 
  3.28  detachment. 
  3.29     [EFFECTIVE DATE.] This section is effective the day 
  3.30  following final enactment.
