1.1 A bill for an act 1.2 relating to civil service; providing for the abolition 1.3 of a police civil service commission by a unanimous 1.4 vote of the city council; amending Minnesota Statutes 1.5 1998, sections 419.16 and 419.17. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 1998, section 419.16, is 1.8 amended to read: 1.9 419.16 [DISCONTINUANCEABOLITION OF COMMISSION.] 1.10AnyA police civil service commissionhereaftercreated 1.11pursuant to the provisions ofunder this chapter may be 1.12discontinued andabolished as follows: (1) by the voters in 1.13 accordance with section 419.17; or (2) by a unanimous vote of 1.14 the city council. Abolition by the voters shall be initiated by 1.15 a petition signed by at least 25 percent of the number of legal 1.16 voters voting at the last general municipal electionshall be1.17 filed with the governing body ofsuchthe cityand shall request1.18 requesting that the following question be submitted to the 1.19 voters: "Shall the police civil service commission be 1.20 abolished?" 1.21 Sec. 2. Minnesota Statutes 1998, section 419.17, is 1.22 amended to read: 1.23 419.17 [DISCONTINUANCEABOLITION SUBMITTED TO VOTERS.] 1.24 Whensucha petition is filed under section 419.16, the 1.25 governing body ofsuchthe city shall cause the question to be 2.1 submitted to the voters at the first following general municipal 2.2 election. The commissionshall be deemed to beis abolished if 2.3 two-thirds of the votes cast in the electionbeare in favor of 2.4suchthe abolishment;, and the status of the police department 2.5 and all oftheits employeesthereofshall thereafterbe deemed2.6tobe the same as if the commission had not been created. 2.7 Sec. 3. [EFFECTIVE DATE.] 2.8 Sections 1 and 2 are effective the day following final 2.9 enactment.
