A bill for an act
relating to transportation; requiring the Department of Transportation to adopt a
pavement use policy; proposing coding for new law in Minnesota Statutes, chapter
174.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) The department must adopt a policy that requires balanced use of asphalt and concrete
pavement surfaces for every project designed, administered, or let for bid by the department
for the following project types under the statewide transportation improvement program:
major construction, reconstruction, reconditioning, resurfacing, roadway repair, safety
capacity, and the highway safety improvement program.

new text begin (b) For the purposes of this section, "balanced" means that of the total dollars spent on
projects under paragraph (a), 50 percent is expended on asphalt pavement and 50 percent
is expended on concrete pavement.
