1.1 A bill for an act 1.2 relating to courts; modifying personal jurisdiction 1.3 over foreign corporations and nonresident individuals 1.4 in certain matters; amending Minnesota Statutes 2002, 1.5 section 543.19, subdivision 1. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 2002, section 543.19, 1.8 subdivision 1, is amended to read: 1.9 Subdivision 1. [PERSONAL JURISDICTION.] As to a cause of 1.10 action arising from any acts enumerated in this subdivision, a 1.11 court of this state with jurisdiction of the subject matter may 1.12 exercise personal jurisdiction over any foreign corporation or 1.13 any nonresident individual, or the individual's personal 1.14 representative, in the same manner as if it were a domestic 1.15 corporation or the individual were a resident of this state. 1.16 This section applies if, in person or through an agent, the 1.17 foreign corporation or nonresident individual: 1.18 (a) owns, uses, or possesses any real or personal property 1.19 situated in this state; or 1.20 (b) transacts any business within the state; or 1.21 (c) commits any act in Minnesota causing injury or property 1.22 damage; or 1.23 (d) commits any act outside Minnesota causing injury or 1.24 property damage in Minnesota, subject to the following 1.25 exceptions when no jurisdiction shall be found: 2.1 (1) Minnesota has no substantial interest in providing a 2.2 forum; or 2.3 (2) the burden placed on the defendant by being brought 2.4 under the state's jurisdiction would violate fairness and 2.5 substantial justice; or2.6(3) the cause of action lies in defamation or privacy. 2.7 Sec. 2. [EFFECTIVE DATE; APPLICATION.] 2.8 Section 1 is effective August 1, 2003, and applies to 2.9 causes of action arising on or after that date.
