  1.1                          A bill for an act 
  1.2             relating to the environment; increasing the license 
  1.3             fee for individual sewage treatment system 
  1.4             contractors; imposing a surcharge; requiring a report; 
  1.5             appropriating money; amending Minnesota Statutes 2002, 
  1.6             section 115.56, subdivision 4; proposing coding for 
  1.7             new law in Minnesota Statutes, chapter 115. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2002, section 115.56, 
  1.10  subdivision 4, is amended to read: 
  1.11     Subd. 4.  [LICENSE FEE.] The fee for a license required 
  1.12  under subdivision 2 is $100 $200 per year.  The maximum total 
  1.13  for multiple licenses is $500.  Revenue from the fees must be 
  1.14  credited to the environmental fund.  This fee is exempt from 
  1.15  section 16A.1285.  
  1.16     Sec. 2.  [115.551] [TANK SURCHARGE.] 
  1.17     A surcharge of $25 is imposed on the sale of each septic 
  1.18  system tank.  The surcharge must be paid at the time the tax is 
  1.19  imposed on the retail sale of a tank, as retail sale is defined 
  1.20  in section 297A.61, subdivision 4.  The commissioner of revenue 
  1.21  has the same powers to collect the surcharge and to impose 
  1.22  penalties that are given to the commissioner with respect to the 
  1.23  collection of sales taxes in chapters 297A and 289A.  Proceeds 
  1.24  from the surcharge collection must be deposited in the 
  1.25  environmental fund and used to administer sections 115.55 to 
  1.26  115.58. 
  2.1      Sec. 3.  [INDUSTRY OVERSIGHT COMMITTEE; REPORT.] 
  2.2      The commissioner of the pollution control agency shall, in 
  2.3   consultation with the individual sewage treatment system 
  2.4   industry, propose a structure for an industry oversight board 
  2.5   that will work with the commissioner on industry oversight.  The 
  2.6   commissioner shall report to the committees of the legislature 
  2.7   with jurisdiction over environmental issues on the proposal and 
  2.8   any other steps the commissioner has taken with respect to 
  2.9   industry oversight by January 15, 2004.  
  2.10     Sec. 4.  [APPROPRIATION.] 
  2.11     $....... is appropriated from the environmental fund to the 
  2.12  commissioner of the pollution control agency to address the need 
  2.13  for increased activity in the areas of new technology review, 
  2.14  technical assistance for local governments, training individual 
  2.15  sewage treatment system professionals, program planning, and 
  2.16  enforcement under Minnesota Statutes, sections 115.55 to 
  2.17  115.58.  Of this amount $....... is available the first year and 
  2.18  $....... is available the second year for grants to counties to 
  2.19  assist in the implementation of individual sewage treatment 
  2.20  system requirements. 
  2.21     Sec. 5.  [EFFECTIVE DATE.] 
  2.22     Sections 1 to 4 are effective July 1, 2003.
