  1.1                          A bill for an act 
  1.2             relating to the environment; banning the sale and 
  1.3             manufacture of fever or basal thermometers containing 
  1.4             mercury; amending Minnesota Statutes 2000, section 
  1.5             116.92, subdivision 6.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 116.92, 
  1.8   subdivision 6, is amended to read: 
  1.9      Subd. 6.  [BAN; MERCURY THERMOMETERS.] (a) A person may not 
  1.10  manufacture, sell, or offer to sell fever or basal thermometers 
  1.11  containing mercury.  
  1.12     (b) A medical facility may not routinely purchase or 
  1.13  distribute fever or basal thermometers containing mercury. 
  1.14     (c) This subdivision does not apply to an electronic 
  1.15  thermometer with a battery containing mercury if the battery is 
  1.16  in compliance with section 325E.125.
