  1.1                          A bill for an act 
  1.2             relating to education; allowing independent school 
  1.3             district No. 279, Osseo, to levy a tax to provide 
  1.4             instructional services to at-risk children; providing 
  1.5             for a low-income concentration grant program; 
  1.6             appropriating money; amending Laws 1994, chapter 647, 
  1.7             article 8, section 41. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Laws 1994, chapter 647, article 8, section 41, 
  1.10  is amended to read: 
  1.11     Sec. 41.  [OSSEO LEVY.] 
  1.12     For 1994 taxes payable in 1995 only, Independent school 
  1.13  district No. 279, Osseo, may levy a tax in an amount not to 
  1.14  exceed $500,000.  The proceeds of this levy must be used to 
  1.15  provide instructional services for at-risk children. 
  1.16     Sec. 2.  [LOW-INCOME CONCENTRATION GRANT PROGRAM.] 
  1.17     Subdivision 1.  [GRANT PROGRAM.] A low-income concentration 
  1.18  grant program is established.  The purpose of the program is to 
  1.19  provide additional resources to school buildings in which the 
  1.20  concentration of children from low-income families is high 
  1.21  compared to the district-wide concentration. 
  1.22     Subd. 2.  [APPLICATION PROCESS.] The commissioner of 
  1.23  education shall develop a grant application process.  In order 
  1.24  to qualify for a grant, the building must be located in a 
  1.25  district that meets the following criteria: 
  1.26     (1) ten percent or more of the district's pupils are 
  2.1   eligible for free and reduced lunch as of October 1 of the 
  2.2   previous fiscal year; 
  2.3      (2) ten percent or more of the district's pupils are 
  2.4   students of color; 
  2.5      (3) the district has at least 1500 students in average 
  2.6   daily membership; and 
  2.7      (4) the district's administrative office is located in the 
  2.8   seven county metropolitan area but not in a city of the first 
  2.9   class. 
  2.10     Subd. 3.  [GRANT USE.] The grant must be used according to 
  2.11  Minnesota Statutes, section 124A.28.  The grant may only be used 
  2.12  in buildings in the district where the percent of children in 
  2.13  the building eligible for free and reduced lunch is at least 20 
  2.14  percent and the number of minority students is at least 20 
  2.15  percent. 
  2.16     Sec. 3.  [APPROPRIATION; LOW-INCOME CONCENTRATION GRANTS.] 
  2.17     $1,000,000 is appropriated from the general fund in fiscal 
  2.18  year 1996 to the department of education for low-income 
  2.19  concentration grants in section 2.
