A bill for an act
relating to claims; providing for compensation of inmates who erroneously serve
an extended prison term; amending Minnesota Statutes 2014, section 3.738,
subdivision 1.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2014, section 3.738, subdivision 1, is amended to read:

The following claims must be presented to,
heard, and determined by the legislature:

institution under the control of the commissioner of human services or the commissioner
of veterans affairs or an inmate of a state correctional facility while performing assigned

(2) claims for compensation based on an erroneous, extended length of imprisonment
in a state correctional facility resulting from an administrative or technical error in
imposing or calculating the length of a sentence, prison term, or release date.

In determining damages under clause (2), the legislature must consider the relevant
items under section 611.365, subdivision 2.
