  1.1                          A bill for an act 
  1.2             relating to agriculture; providing for food handler 
  1.3             certification; proposing coding for new law in 
  1.4             Minnesota Statutes, chapter 31. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [31.96] [FOOD HANDLER CERTIFICATION.] 
  1.7      The commissioner may require certification of retail food 
  1.8   handlers in establishments licensed under section 28A.05, 
  1.9   paragraph (a), for retail food preparation, handling, and 
  1.10  service practices.  A retail food handler licensed under section 
  1.11  28A.05, paragraph (a), shall comply with the requirements for 
  1.12  the manager certification program under section 157.011, 
  1.13  subdivision 2.  An interagency agreement with the department of 
  1.14  health must be established for the transfer of funds to the 
  1.15  commissioner to cover the cost of administering the manager 
  1.16  certification program. 
  1.17     Sec. 2.  [LEGISLATIVE REVIEW OF RULES.] 
  1.18     Before implementation of the rules required to establish a 
  1.19  certification program for retail food handlers under section 1, 
  1.20  and no later than January 15, 1998, the departments of 
  1.21  agriculture and health must submit the rules and any public 
  1.22  comments on the rules to the agriculture committees of the 
  1.23  legislature.  The rules may not be enforced before July 1, 1998.
