A bill for an act
relating to corrections; modifying work release; expanding the Minnesota
Rehabilitation and Reinvestment Act formula to certain programs; amending
Minnesota Statutes 2022, section 244.065, subdivision 1; Minnesota Statutes 2023
Supplement, sections 244.41, subdivision 10; 244.50, subdivision 2.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2022, section 244.065, subdivision 1, is amended to read:


Subdivision 1.

Work.

When consistent with the public interest and the public safety,
the commissioner of corrections deleted text begin maydeleted text end new text begin shallnew text end conditionally release an inmate to work at paid
employment, seek employment, or participate in a vocational training or educational program,
as provided in section 241.26, if the inmatenew text begin agrees andnew text end has served at least one half of the
term of imprisonment.

Sec. 2.

Minnesota Statutes 2023 Supplement, section 244.41, subdivision 10, is amended
to read:


Subd. 10.

Incarcerated days saved.

"Incarcerated days saved" means the number of
days of an incarcerated person's original term of imprisonment minus the number of actual
days served, new text begin or served in a less expensive community-based setting, new text end excluding days not
served due to death deleted text begin or as a result of time earned in the challenge incarceration program
under sections 244.17 to 244.173

Sec. 3.

Minnesota Statutes 2023 Supplement, section 244.50, subdivision 2, is amended
to read:


Subd. 2.

Certifying earned incentive release savings.

On or before the final closeout
date of each fiscal year, the commissioner must certify to Minnesota Management and
Budget the earned incentive release savings from the previous fiscal year. The commissioner
must provide the detailed calculation substantiating the savings amount, including
accounting-system-generated data where possible, supporting the direct-cost per diem and
the incarcerated days saved.new text begin Savings under sections 244.17 to 244.173 and 244.065 shall
be calculated the year of completion or failure of the program, minus any per diem program
costs.
