A bill for an act
relating to human services; directing the commissioner of human services to apply
for a federal waiver for money for services provided to patients in an institution
for mental diseases.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin DIRECTION TO COMMISSIONER OF HUMAN SERVICES;
INSTITUTION FOR MENTAL DISEASES 1115 DEMONSTRATION WAIVER.

new text begin (a) The commissioner of human services shall apply to the federal Secretary of Health
and Human Services for a section 1115 demonstration waiver to receive federal Medicaid
money for services provided to patients in an institution for mental diseases. The waiver
must incorporate priorities for population health and seek to obtain federal Medicaid money
including but not limited to money for patients under the age of 21 in an institution for
mental diseases.

this section no later than October 30, 2024. The commissioner must engage community
stakeholders, including but not limited to providers and advocates, to inform the application.
