  1.1                          A bill for an act 
  1.2             relating to local government; exempting certain 
  1.3             property in Washington County from condemnation 
  1.4             proceedings; designating certain property as a 
  1.5             conforming planned unit development for purposes of 
  1.6             county zoning controls; providing tax-exempt status 
  1.7             for certain real and personal property used for 
  1.8             recreational purposes; excluding certain recreational 
  1.9             property from the metropolitan regional open space 
  1.10            system; prohibiting a county from restricting access 
  1.11            to and from certain recreational property; requiring 
  1.12            certain duties of the Disabled Veterans Rest Camp in 
  1.13            Washington County; amending Minnesota Statutes 2004, 
  1.14            sections 272.02, by adding a subdivision; 394.25, by 
  1.15            adding a subdivision; 462.357, by adding a 
  1.16            subdivision; 473.147, by adding a subdivision. 
  1.17  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.18     Section 1.  Minnesota Statutes 2004, section 272.02, is 
  1.19  amended by adding a subdivision to read: 
  1.20     Subd. 68.  [CERTAIN RECREATIONAL PROPERTY FOR DISABLED 
  1.21  VETERANS.] Real and personal property is exempt if it is located 
  1.22  in a county in the metropolitan area with a population of less 
  1.23  than 500,000, and owned or leased and operated by a nonprofit 
  1.24  organization, and primarily used to provide recreational 
  1.25  opportunities for disabled veterans and their families. 
  1.26     Sec. 2.  Minnesota Statutes 2004, section 394.25, is 
  1.27  amended by adding a subdivision to read: 
  1.28     Subd. 3d.  [NONPROFIT RECREATIONAL PROPERTY FOR USE BY 
  1.29  DISABLED VETERANS.] Property located in a county in the 
  1.30  metropolitan area with a population of less than 500,000, and 
  1.31  owned or leased and operated by a nonprofit organization, and 
  2.1   primarily used to provide recreational opportunities for 
  2.2   disabled veterans and their families is a planned unit 
  2.3   development district and a legal conforming use for purposes of 
  2.4   zoning controls. 
  2.5      Sec. 3.  Minnesota Statutes 2004, section 462.357, is 
  2.6   amended by adding a subdivision to read: 
  2.7      Subd. 1g.  [NONPROFIT RECREATIONAL PROPERTY FOR USE BY 
  2.8   DISABLED VETERANS.] Property located in a county in the 
  2.9   metropolitan area with a population of less than 500,000, and 
  2.10  owned or leased and operated by a nonprofit organization, and 
  2.11  primarily used to provide recreational opportunities for 
  2.12  disabled veterans and their families is a planned unit 
  2.13  development district and legal conforming use for purposes of 
  2.14  zoning controls. 
  2.15     Sec. 4.  Minnesota Statutes 2004, section 473.147, is 
  2.16  amended by adding a subdivision to read: 
  2.17     Subd. 1a.  [DISABLED VETERANS REST CAMP EXCLUDED FROM 
  2.18  REGIONAL RECREATIONAL OPEN SPACE SYSTEM.] Property occupied by 
  2.19  the Disabled Veterans Rest Camp on Big Marine Lake in Washington 
  2.20  County is excluded from the regional recreational open space 
  2.21  system. 
  2.22     Sec. 5.  [WASHINGTON COUNTY; EMINENT DOMAIN.] 
  2.23     Subdivision 1.  [LIMITATION ON CONDEMNATION.] Washington 
  2.24  County may not acquire by eminent domain property owned or 
  2.25  leased and operated by a nonprofit organization and primarily 
  2.26  used to provide recreational opportunities to disabled veterans 
  2.27  and their families. 
  2.28     Subd. 2.  [LOCAL APPROVAL.] This section takes effect the 
  2.29  day after the governing body of Washington County complies with 
  2.30  Minnesota Statutes, section 645.021, subdivision 3. 
  2.31     Sec. 6.  [RESTRICTIONS LIMITED.] 
  2.32     No county may take any action to encumber or restrict 
  2.33  ingress or egress below levels permissible on January 1, 2005, 
  2.34  to property located in a county in the metropolitan area with a 
  2.35  population of less than 500,000, and owned or leased and 
  2.36  operated by a nonprofit organization, and primarily used to 
  3.1   provide recreational opportunities to disabled veterans and 
  3.2   their families. 
  3.3      Sec. 7.  [DISABLED VETERANS CAMP REQUIREMENTS.] 
  3.4      The Disabled Veterans Rest Camp on Big Marine Lake in 
  3.5   Washington County ("The Camp") must develop and promote camp 
  3.6   features and amenities for veterans who are disabled or have 
  3.7   limited physical capabilities.  The Camp, by terms of separate 
  3.8   agreements, must offer Washington County the right of first 
  3.9   refusal to purchase the rest camp property if a sale is ever 
  3.10  contemplated and provide an easement across the main Veterans 
  3.11  Rest Camp Road in order to provide a connection of the north and 
  3.12  south areas of the park.  The Camp shall modify its operating 
  3.13  policies and procedures to include provisions for the regular 
  3.14  rotation of the use of campsites, cabins, and parking spots for 
  3.15  travel trailers, limiting the time that any one veteran can use 
  3.16  the cabin and campsites especially when there is a waiting list 
  3.17  of veterans with service connected disabilities. 
  3.18     Sec. 8.  [EFFECTIVE DATES.] 
  3.19     Section 1 is effective for assessment year 2005 and 
  3.20  thereafter for taxes payable in 2006 and thereafter.  Sections 2 
  3.21  to 4, 6, and 7, are effective the day following final enactment.
