A bill for an act
relating to transportation; modifying requirements for providing access to property
owners upon vacating local roads; amending Minnesota Statutes 2022, section
160.09, subdivision 3.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2022, section 160.09, subdivision 3, is amended to read:


Subd. 3.

Local road not vacated in certain cases.

When a county highway or town
road is the only means of access to any property or properties containing an area or combined
area of five acres or more, the highway or road shall not be vacated without the consent of
the property owner unless other means of access are provided.new text begin A road authority may satisfy
this subdivision by altering the road into a cartway through the proceedings specified in
section 164.07. When altering a road into a cartway, no town funds may be expended on
maintenance unless the town board determines by resolution that an expenditure is in the
public interest. If the town board does not determine that an expenditure is in the public
interest, the costs of maintaining the cartway are subject to the provisions of section 164.08,
subdivision 3.
