A bill for an act
relating to state lands; providing for private sale of certain state land to Olmsted
County; appropriating money.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin PRIVATE SALE OF LAND IN GORDON W. YEAGER WILDLIFE
MANAGEMENT AREA; OLMSTED COUNTY.

new text begin (a) Notwithstanding any law to the contrary, the commissioner of natural resources may
sell by private sale the land located in the Gordon W. Yeager Wildlife Management Area
and described in paragraph (b) to Olmsted County.

new text begin (b) The approximately 39.30 acres of land to be conveyed is located in Olmsted County
and is described as: that part of the North Half of the Southeast Quarter and part of the
Southeast Quarter of the Northeast Quarter, all in Section 31, Township 107 North, Range
13 West, Olmsted County, Minnesota, lying westerly of the centerline of County State-Aid
Highway 22, as it existed on January 25, 2022, and being the center of the 200-foot-wide
right-of-way easement described on page one of "Exhibit A" in that certain right-of-way
easement recorded as Document Number 513775 in the Office of the Olmsted County
Recorder, and southerly of the south line of the Dakota, Minnesota, and Eastern Railroad
and northerly of the north line of the South 1,470.00 feet of said Southeast Quarter of Section
31, excepting therefrom the part described as follows: that part of the Southeast Quarter of
Section 31, Township 107 North, Range 13 West, commencing at the southwest corner of
the Southeast Quarter; thence North 00 degrees 43 minutes 17 seconds West, all bearings
being in relationship to the west line of the Southeast Quarter, along said west line 1,568.11
feet to the point of beginning; thence continuing North 00 degrees 43 minutes 17 seconds
West 696.80 feet along the west line of said quarter to the south right-of-way line of the
railroad; thence North 75 degrees 01 minutes 38 seconds East 1,274.05 feet along said south
right-of-way line; thence South 14 degrees 58 minutes 22 seconds East 160.00 feet; thence
South 75 degrees 01 minutes 38 seconds West, parallel to the railroad right-of-way, 940.00
feet; thence South 00 degrees 43 minutes 17 seconds East, parallel with the west line of the
Southeast Quarter 608.52 feet; thence South 86 degrees 50 minutes 39 seconds West 363.48
feet to the point of beginning and there terminating.

new text begin (c) The commissioner of natural resources and Olmsted County must negotiate and
develop a plan to convey the land described in paragraph (b) to the county. The plan must
include mutual agreement on the terms of the conveyance, such as financial compensation
and conditions to ensure that the operational needs of the Department of Natural Resources
and any partner agencies are met. By November 1, 2022, the commissioner must submit
the plan to the chairs and ranking minority members of the house of representatives and
senate committees and divisions with jurisdiction over environment and natural resources.

new text begin (d) If the commissioner of natural resources and Olmsted County can reach mutually
agreeable terms to convey the land, the land must be conveyed by quitclaim deed in a form
approved by the attorney general. The attorney general may make changes to the land
description to correct errors and ensure accuracy. The conveyance must reserve to the state
all minerals and mineral rights and must provide that the land reverts to the state if it is not
used for public purposes. The proceeds received from the sale must be deposited in the land
acquisition account in the natural resources fund and are appropriated to the commissioner
of natural resources to acquire replacement wildlife management area lands.
