1.1 A bill for an act 1.2 relating to human services; requiring specialized 1.3 Alzheimer's disease training in certain facilities and 1.4 services; providing for consumer disclosure; amending 1.5 Minnesota Statutes 2002, sections 144A.45, by adding a 1.6 subdivision; 245A.04, by adding a subdivision; 1.7 proposing coding for new law in Minnesota Statutes, 1.8 chapters 144; 144D. 1.9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.10 Section 1. [144.6503] [NURSING FACILITIES THAT SERVE 1.11 PERSONS WITH ALZHEIMER'S DISEASE OR RELATED DISORDERS.] 1.12 (a) If a nursing facility markets or otherwise promotes 1.13 services for persons with Alzheimer's disease or related 1.14 disorders, whether in a segregated or general unit, the 1.15 facility's direct care staff and their supervisors must be 1.16 trained in dementia care. 1.17 (b) Areas of required training include: 1.18 (1) an explanation of Alzheimer's disease and related 1.19 disorders; 1.20 (2) assistance with activities of daily living; 1.21 (3) problem solving with challenging behaviors; and 1.22 (4) communication skills. 1.23 (c) The facility shall provide to consumers in written or 1.24 electronic form a description of the training program, the 1.25 categories of employees trained, the frequency of training, and 1.26 the basic topics covered. 1.27 Sec. 2. Minnesota Statutes 2002, section 144A.45, is 2.1 amended by adding a subdivision to read: 2.2 Subd. 5. [HOME CARE PROVIDERS THAT SERVE PERSONS WITH 2.3 ALZHEIMER'S DISEASE OR RELATED DISORDERS.] (a) If a home care 2.4 provider licensed under section 144A.46 or 144A.4605 markets or 2.5 otherwise promotes services for persons with Alzheimer's disease 2.6 or related disorders, the facility's direct care staff and their 2.7 supervisors must be trained in dementia care. 2.8 (b) Areas of required training include: 2.9 (1) an explanation of Alzheimer's disease and related 2.10 disorders; 2.11 (2) assistance with activities of daily living; 2.12 (3) problem solving with challenging behaviors; and 2.13 (4) communication skills. 2.14 (c) The licensee shall provide to consumers in written or 2.15 electronic form a description of the training program, the 2.16 categories of employees trained, the frequency of training, and 2.17 the basic topics covered. 2.18 Sec. 3. [144D.065] [ESTABLISHMENTS THAT SERVE PERSONS WITH 2.19 ALZHEIMER'S DISEASE OR RELATED DISORDERS.] 2.20 (a) If a housing with services establishment registered 2.21 under this chapter markets or otherwise promotes services for 2.22 persons with Alzheimer's disease or related disorders, whether 2.23 in a segregated or general unit, the facility's direct care 2.24 staff and their supervisors must be trained in dementia care. 2.25 (b) Areas of required training include: 2.26 (1) an explanation of Alzheimer's disease and related 2.27 disorders; 2.28 (2) assistance with activities of daily living; 2.29 (3) problem solving with challenging behaviors; and 2.30 (4) communication skills. 2.31 (c) The establishment shall provide to consumers in written 2.32 or electronic form a description of the training program, the 2.33 categories of employees trained, the frequency of training, and 2.34 the basic topics covered. This information satisfies the 2.35 disclosure requirements of section 325F.72, subdivision 2, 2.36 clause (4). 3.1 Sec. 4. Minnesota Statutes 2002, section 245A.04, is 3.2 amended by adding a subdivision to read: 3.3 Subd. 12. [ADULT DAY CARE FACILITIES THAT SERVE PERSONS 3.4 WITH ALZHEIMER'S DISEASE OR RELATED DISORDERS.] (a) If an adult 3.5 day care facility markets or otherwise promotes services for 3.6 persons with Alzheimer's disease or related disorders, the 3.7 facility's direct care staff and their supervisors must be 3.8 trained in dementia care. 3.9 (b) Areas of required training include: 3.10 (1) an explanation of Alzheimer's disease and related 3.11 disorders; 3.12 (2) assistance with activities of daily living; 3.13 (3) problem solving with challenging behaviors; and 3.14 (4) communication skills. 3.15 (c) The facility shall provide to consumers in written or 3.16 electronic form a description of the training program, the 3.17 categories of employees trained, the frequency of training, and 3.18 the basic topics covered.
