A bill for an act
relating to child care licensing; modifying employment qualifications and the
definition of education for child care centers; amending Minnesota Statutes 2023
Supplement, section 245A.02, subdivision 6b.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2023 Supplement, section 245A.02, subdivision 6b, is
amended to read:


Subd. 6b.

Experience.

For purposes of child care centers, "experience" means paid or
unpaid employment:

(1) caring for children as a teacher, assistant teacher, aide, or student intern:

(i) in a licensed child care center, a licensed family day care or group family day care,
or a Tribally licensed child care program in any United States state or territory; or

(ii) in a public or nonpublic school;

(2) caring for children as a staff person or unsupervised volunteer in a certified,
license-exempt child care center under chapter 245H; deleted text begin or

(3) providing direct contact services in a home or residential facility serving children
with disabilities that requires a background study under section 245C.03deleted text begin .deleted text end new text begin ;

new text begin (4) providing direct contact services to elderly or disabled adults that require a background
study under section 245C.03; or

new text begin (5) caring for children in their own home under an arrangement that is excluded from
licensing requirements under section 245A.03, subdivision 2.

Sec. 2. new text begin DIRECTION TO THE COMMISSIONER OF HUMAN SERVICES;
AMENDING STAFF EDUCATION RULES FOR CHILD CARE CENTERS.

new text begin (a) The commissioner of human services must amend the definition of education in
Minnesota Rules, part 9503.0030, subpart 1, item B, to provide that education means
accredited course work in any subject from an accredited post secondary institution, including
but not limited to Tribal colleges.

new text begin (b) For purposes of this section, the commissioner may use the good cause exemption
process under Minnesota Statutes, section 14.388, subdivision 1, clause (3), and Minnesota
Statutes, section 14.386, does not apply.
