  1.1                          A bill for an act 
  1.2             relating to game and fish; providing for certain 
  1.3             lifetime game and fish licenses; establishing the 
  1.4             lifetime fish and wildlife trust fund; imposing fees; 
  1.5             requiring an annual report; proposing coding for new 
  1.6             law in Minnesota Statutes, chapter 97A. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [97A.473] [RESIDENT LIFETIME LICENSES.] 
  1.9      Subdivision 1.  [RESIDENT LIFETIME LICENSES 
  1.10  AUTHORIZED.] The commissioner may issue a lifetime angling 
  1.11  license, a lifetime small game hunting license, a lifetime 
  1.12  firearms deer license, or a lifetime sporting license to a 
  1.13  resident of the state. 
  1.14     Subd. 2.  [LIFETIME ANGLING LICENSE; FEE.] (a) A resident 
  1.15  lifetime angling license authorizes a resident to take fish by 
  1.16  angling in the state.  The license authorizes those activities 
  1.17  authorized by the annual resident angling license.  The license 
  1.18  does not include a trout and salmon stamp.  
  1.19     (b) The fees for a resident lifetime angling license are: 
  1.20     (1) age 15 and under, $...; 
  1.21     (2) age 16 to age 64, $...; and 
  1.22     (3) age 65 and over, $.... 
  1.23     Subd. 3.  [LIFETIME SMALL GAME HUNTING LICENSE; FEE.] (a) A 
  1.24  resident lifetime small game hunting license authorizes a 
  1.25  resident to hunt small game in the state.  The license 
  1.26  authorizes those hunting activities authorized by the annual 
  2.1   resident small game hunting license.  The license does not 
  2.2   include any of the hunting stamps required in the state. 
  2.3      (b) The fees for a resident lifetime small game hunting 
  2.4   license are: 
  2.5      (1) age 15 and under, $...; 
  2.6      (2) age 16 to age 64, $...; and 
  2.7      (3) age 65 and over, $.... 
  2.8      Subd. 4.  [LIFETIME FIREARM DEER HUNTING LICENSE; FEE.] (a) 
  2.9   A resident lifetime firearm deer hunting license authorizes a 
  2.10  resident to take deer with firearms in the state.  The license 
  2.11  authorizes those activities authorized by the annual resident 
  2.12  firearm deer hunting license. 
  2.13     (b) The fees for a resident lifetime firearm deer hunting 
  2.14  license are: 
  2.15     (1) age 15 and under, $...; 
  2.16     (2) age 16 to age 64, $...; and 
  2.17     (3) age 65 and over, $.... 
  2.18     Subd. 5.  [LIFETIME SPORTING LICENSE; FEE.] (a) A resident 
  2.19  lifetime sporting license authorizes a resident to take fish by 
  2.20  angling and hunt small game in the state.  The license 
  2.21  authorizes those activities authorized by the annual resident 
  2.22  angling and resident small game hunting licenses.  The license 
  2.23  does not include a trout and salmon stamp or any of the hunting 
  2.24  stamps required in the state.  
  2.25     (b) The fees for a resident lifetime sporting license are: 
  2.26     (1) age 15 and under, $...; 
  2.27     (2) age 16 to age 64, $...; and 
  2.28     (3) age 65 and over, $.... 
  2.29     Sec. 2.  [97A.474] [NONRESIDENT LIFETIME LICENSES.] 
  2.30     Subdivision 1.  [NONRESIDENT LIFETIME LICENSES AUTHORIZED.] 
  2.31  The commissioner may issue a lifetime angling license, a 
  2.32  lifetime small game hunting license, a lifetime firearms deer 
  2.33  hunting license, or a lifetime sporting license to a nonresident 
  2.34  of the state. 
  2.35     Subd. 2.  [NONRESIDENT LIFETIME ANGLING LICENSE; FEE.] (a) 
  2.36  A nonresident lifetime angling license authorizes a nonresident 
  3.1   to take fish by angling in the state.  The license authorizes 
  3.2   those activities authorized by the annual nonresident angling 
  3.3   license.  The license does not include a trout and salmon stamp. 
  3.4      (b) The fees for a nonresident lifetime angling license are:
  3.5      (1) age 15 and under, $...; 
  3.6      (2) age 16 to age 64, $...; and 
  3.7      (3) age 65 and over, $.... 
  3.8      Subd. 3.  [NONRESIDENT LIFETIME SMALL GAME HUNTING LICENSE; 
  3.9   FEE.] (a) A nonresident lifetime small game hunting license 
  3.10  authorizes a nonresident to hunt small game in the state.  The 
  3.11  license authorizes those hunting activities authorized by the 
  3.12  annual nonresident small game hunting license.  The license does 
  3.13  not include any of the hunting stamps required in the state.  
  3.14     (b) The fees for a nonresident lifetime small game hunting 
  3.15  license are: 
  3.16     (1) age 15 and under, $...; 
  3.17     (2) age 16 to age 64, $...; and 
  3.18     (3) age 65 and over, $.... 
  3.19     Subd. 4.  [NONRESIDENT LIFETIME FIREARM DEER HUNTING 
  3.20  LICENSE; FEE.] (a) A nonresident lifetime firearm deer hunting 
  3.21  license authorizes a nonresident to take deer with firearms in 
  3.22  the state.  The license authorizes those activities authorized 
  3.23  by the annual nonresident firearm deer hunting license. 
  3.24     (b) The fees for a nonresident lifetime firearm deer 
  3.25  hunting license are: 
  3.26     (1) age 15 and under, $...; 
  3.27     (2) age 16 to age 64, $...; and 
  3.28     (3) age 65 and over, $.... 
  3.29     Subd. 5.  [NONRESIDENT LIFETIME SPORTING LICENSE; FEE.] (a) 
  3.30  A nonresident lifetime sporting license authorizes a nonresident 
  3.31  to take fish by angling and hunt small game in the state.  The 
  3.32  license authorizes those activities authorized by the annual 
  3.33  nonresident angling and small game hunting licenses.  The 
  3.34  license does not include a trout and salmon stamp or any of the 
  3.35  hunting stamps required in the state.  
  3.36     (b) The fees for a nonresident lifetime sporting license 
  4.1   are: 
  4.2      (1) age 15 and under, $...; 
  4.3      (2) age 16 to age 64, $...; and 
  4.4      (3) age 65 and over, $.... 
  4.5      Sec. 3.  [97A.4742] [LIFETIME FISH AND WILDLIFE TRUST 
  4.6   FUND.] 
  4.7      Subdivision 1.  [ESTABLISHMENT; PURPOSE.] The lifetime fish 
  4.8   and wildlife trust fund is established as an account in the game 
  4.9   and fish fund in the state treasury.  The state treasurer shall 
  4.10  credit to the lifetime fish and wildlife trust fund all money 
  4.11  received from the issuance of resident lifetime and nonresident 
  4.12  lifetime angling, small game hunting, firearm deer hunting, and 
  4.13  sporting licenses. 
  4.14     Subd. 2.  [INVESTMENT OF FUND; USE OF INCOME FROM 
  4.15  FUND.] Money shall be invested according to law for the benefit 
  4.16  of the fund.  Neither the money of the fund, nor the interest 
  4.17  accruing on investments of and deposits to the fund, shall be 
  4.18  used for any other purposes than those set out in this section, 
  4.19  nor shall any part of the fund be diverted to the general fund 
  4.20  or any other fund.  No expenditure or disbursement shall be made 
  4.21  from the principal of the lifetime fish and wildlife trust 
  4.22  fund.  The income received and accruing from the investments of 
  4.23  the lifetime fish and wildlife trust fund may be spent only for 
  4.24  species and habitat improvement.  Fifty percent of the income 
  4.25  received from the investments must be spent on habitat 
  4.26  improvement.  The other 50 percent of the income received from 
  4.27  the investments in the fund must be spent on species stocking.  
  4.28  The commissioner has discretion over the spending within these 
  4.29  limits. 
  4.30     Subd. 3.  [LIFETIME LICENSE FEES.] To provide for 
  4.31  long-range planning of the lifetime fish and wildlife trust 
  4.32  fund, the policy of the state is to make fee adjustments as part 
  4.33  of the budget process.  The commissioner shall make specific 
  4.34  requests for fee adjustments for the lifetime licenses as part 
  4.35  of a fee report.  The commissioner of finance shall review the 
  4.36  fee report and make recommendations to the governor and 
  5.1   legislature for each fee.  Fee adjustment recommendations may 
  5.2   only be implemented upon approval of the legislature. 
  5.3      Subd. 4.  [ANNUAL REPORT.] By November 15 each year, the 
  5.4   commissioner shall submit a report to the legislative committees 
  5.5   having jurisdiction over appropriations and the environment and 
  5.6   natural resources.  The report shall state the amount of revenue 
  5.7   received in and expenditures made from the lifetime fish and 
  5.8   wildlife trust fund and shall describe projects funded, 
  5.9   locations of the projects, and results and benefits from the 
  5.10  projects.  The commissioner shall make the annual report 
  5.11  available to the public.
