1.1 A bill for an act 1.2 relating to insurance; automobile; modifying the 1.3 eligibility for a premium reduction upon completion of 1.4 the required accident prevention course; amending 1.5 Minnesota Statutes 1998, section 65B.28, subdivisions 1.6 1, 2, and 4. 1.7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8 Section 1. Minnesota Statutes 1998, section 65B.28, 1.9 subdivision 1, is amended to read: 1.10 Subdivision 1. [REQUIRED REDUCTION.] An insurer must 1.11 provide an appropriate premium reduction of at least ten percent 1.12 on its policies of private passenger vehicle insurance, as 1.13 defined in section 65B.001, subdivision 2, issued, delivered, or 1.14 renewed in this state, to insureds55 years old and olderwho 1.15 successfully complete an accident prevention course or refresher 1.16 course established under subdivisions 2 and 3. 1.17 Sec. 2. Minnesota Statutes 1998, section 65B.28, 1.18 subdivision 2, is amended to read: 1.19 Subd. 2. [ACCIDENT PREVENTION COURSE; RULES.] The 1.20 commissioner of public safety shall adopt rules establishing and 1.21 regulating a motor vehicle accident prevention coursefor1.22persons 55 years old and older. The rules must, at a minimum, 1.23 include provisions: 1.24 (1) establishing curriculum requirements; 1.25 (2) establishing the number of hours required for 1.26 successful completion of the course; and 2.1 (3) providing for the issuance of a course completion 2.2 certification and requiring its submission to an insured as 2.3 evidence of completion of the course. 2.4 Sec. 3. Minnesota Statutes 1998, section 65B.28, 2.5 subdivision 4, is amended to read: 2.6 Subd. 4. [COMPLETION CERTIFICATE.] Persons55 years old2.7and oldermay retake the original course or take the refresher 2.8 course every three years and receive a course completion 2.9 certificate to remain eligible for the premium reduction in 2.10 subdivision 1. The department of public safety shall provide 2.11 criteria for the issuance of the course completion certificates. 2.12 Sec. 4. [EFFECTIVE DATE.] 2.13 Sections 1 to 3 are effective the day following final 2.14 enactment.
