A bill for an act
 relating to natural resources; requiring amendment to shoreland management
rules.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin SHORELAND MANAGEMENT RULE AMENDMENT.

new text begin By September 1, 2009, the commissioner of natural resources shall amend Minnesota
Rules, parts 6120.2500 to 6120.3900, to define "impervious surface." The definition of
impervious surface adopted under this section must specifically exclude a deck attached
to a building, regardless of whether plastic sheeting is installed under the deck. The
commissioner may use the good cause exemption under Minnesota Statutes, section
14.388, subdivision 1, clause (3), to adopt the definition and Minnesota Statutes, section
14.386, does not apply except as provided under Minnesota Statutes, section 14.388.
